ADMINISTRATIVE ORDER NO. 58-00-26-F <br /> of the <br /> City Manager of the City of Eugene <br /> <br /> ~i <br /> <br /> I <br /> MENDMENT OF EROSION PREVENTION AND <br /> ONSTRUCTION SITE MANAGEMENT PRACTICES <br /> DMINISTRATIVE RULE R-6.645 AND REPEAL OF <br /> DMINISTRATIVE ORDER NO. 58-96-26-F. <br /> The Ci Manager of the City of Eugene finds that: <br /> A. ursuant to the authority contained in Sections 2.019 and 6.645 of the Eugene Code, <br /> 1971, Erosion evention and Construction Site Management Practices Administrative Rule R-6.645 <br /> was adopted o January 22, 1997 by Administrative Order No. 58-96-26-F establishing a program <br /> for managing a osion and other negative water quality impacts associated with construction activities. <br /> B. Based on the findings contained in Administrative Order No. 58-00-26 issued on <br /> October 17, 000 I proposed revisions to the rules to address issues that have arisen during <br /> implementatio of its provisions as more particularly set forth in Finding B of the order and in the <br /> Notice of Inte ded Rulemaking. <br /> C. Notice of the proposed amendments was published in the Register-Guard for five <br /> consecutive d ys, to-wit, on October 20, 21, 22, 23, and 24, 2000. The Notice was also made <br /> available to pe sons who had requested such notice, and provided that written comments would be <br /> received ther on for a period of 15 days from the first date of publication. No written comments <br /> were received 'thin the time and manner required by the notice, but during the comment period staff <br /> recommende that the "Examples of `G' violations" set forth in R-6.645-I be deleted in order to <br /> avoid potential confusion as to their applicability. I agree with the recommendation, and the examples <br /> have been del ted from the Rule. <br /> Based upon the above findings, which are hereby adopted, and pursuant to the authority <br /> contained in ections 2.019 and 6.645 of the Eugene Code, 1971, I hereby repeal Administrative <br /> Order No. 5 -96-26-F as of the effective date of this order, amend Erosion Prevention and <br /> Construction ite Management Practices Administrative Rule R-6.645 as proposed in Administrative <br /> Order No. 58 26 and amended as noted in finding C above, and ratify the unamended portions of <br /> Rule R-6.645 so it provides in full as follows: <br /> EROSION PREVENTION AND CONSTRUCTION SITE <br /> NAGEMENT PRACTICES ADMINISTRATIVE RULER 6.645 <br /> Administrati Rule - 1 <br /> r:~adminord~ules\ ,osprev2ao.wpd(12/07/00) <br /> <br />
