The following construction site practices are prohibited and <br /> 'I constitute a vi lation of these rules: <br /> 1.1 Im ro er sto a of chemicals esticides fertilizers fuels amts thinners)' <br /> P P ~ ~P ,P ~ , <br /> 1.2 Improper disposal of construction waste material, garbage, rubbish, and <br /> sanita waste, plaster, dry-wall, grout, gypsum; <br /> 1.3 Failure to immediately clean up spills of toxic materials; <br /> 1.4 Washing excess concrete material into a street, catch basin, or other public <br /> facili or a related natural resource; <br /> 1.5 Leaving stockpiles uncovered, without approved secondary containment <br /> faciliti s; <br /> 1.6 Allowing construction vehicles to track or spill soil or debris into or onto a <br /> street r public right of way; or <br /> 1.7 Ground disturbing activities or destruction of vegetation in protected areas. <br /> 2. Prevention Measures and Design Standards. The City's Erosion Prevention and <br /> 'Construction ite Management Practices Manual may be utilized to obtain ideas as to how to achieve <br /> the outcomes mandated by R-6.645-D.1. The Manual is a guidance document only. Except as <br /> provided in R 6.645-D, it is not necessary to utilize any of the specific best management practices <br /> contained in a Manual, nor is the use of one or more of those best management practices a <br /> guarantee that pernut will be issued. Each site and the proposed construction related activities need <br /> to be examine to determine what measures are required for that specific site. <br /> <br /> I <br /> ~ R 6.645-H Enforcement. <br /> 1. Intervention. The primary focus of sections 6.625 to 6.645 of the Eugene Code, <br /> 1971 and th Rules is to achieve compliance with the outcomes specified in R-6.645-D and prevent <br /> erosion and co trol stormwater impact, and the City will use the amount of enforcement necessary <br /> to achieve co pliance. Where possible the City will rely on education rather than enforcement. The <br /> City Manage may provide educational programs or other informational materials that will assist <br /> penmittees in eeting the desired erosion and sedimentation controls, and other construction site <br /> management ractices outcomes. <br /> 2. S~4p Work Order. Whenever any construction related activity is being done contrary <br /> <br /> j to and in viola ion of Sections 6.625 to 6.645 of the Eugene Code, 1971, these rules, or an erosion <br /> <br /> j prevention pe 't, the enforcement officer may order the construction related activity stopped by <br /> notice in wri ' g, posted on the premises, or served on the permittee. The permittee shall forthwith <br /> stop such wo until authorized by the enforcement officer to proceed. <br /> 3 Citation for Violation. Upon a determination that a person is violating Sections <br /> 6.625 to 6.645 of the Eugene Code, 1971 or these rules, a citation maybe issued to the permittee to <br /> appear in Mu "cipal Court. <br /> 4 Administrative Compliance Order.
