I - <br /> <br /> ' ~ <br /> i <br /> i ADMINISTRATIVE ORDER NO. 58-02-12 <br /> of the <br /> ~r I City Manager pro tem of the City of Eugene <br /> CONCERNING NOTICE OF INTENDED REPEAL OF ADMINISTRATIVE <br /> ORDER N0.58-01-11-F, THE SYSTEMS DEVELOPMENT CHARGE (SDC) <br /> METHODOLOGY ADOPTED THEREIN. <br /> The City Manager pro tem of the City of Eugene finds as follows: <br /> i <br /> A. The Systems Development Charges (SDC) Methodology was originally adopted by <br /> Ordinance No. 19773 on May 13, 1991. That Ordinance provided that all future modifications to <br /> ! the Methodology be made by Administrative Order of the City Manage: Pursuant to that provision, <br /> ~ subsequent amendments to the SDC Methodology were made by Administrative Order; the most <br /> recent amendment occurring on June 29, 2001, by Administrative Order No. 58-01-11-F. <br /> B. The 2001 Legislative Assembly amended the state SDC statutes and clarified that the <br /> process for adopting and amending SDC Methodologies should be by Council Resolution or <br /> ~ Ordinance. However, adjustments to SDC rate factors and cost indices may be accomplished <br /> administratively. On Apri18, 2002, Ordinance No. 20248 was adopted amending Chapter 7 of the <br /> Eugene Code, l 971, to bring the Eugene Code in compliance the state SDC statutes. That Ordinance <br /> will become effective on May 8, 2002, and the Council also adopted a Resolution adopting the SDC <br /> Methodologies on April 8, 2002, which will become effective on May 8, 2002. That Resolution <br /> provides that future adjustments to SDC rate factors and cost indices shall be accomplished by <br /> Administrative Order of the City Manager pursuant to Section 2.020 of the Eugene Code, 1971. <br /> i <br /> ~ ` C. I therefore intend to repeal Administrative Order No. 58-01-11-F and the SDC <br /> ~ Methodology adopted therein upon the effective date of the Council Resolution adopting the SDC <br /> Methodologies. <br /> i <br /> I On the basis of these findings, I order that: <br /> ' 1. Copies of the Notice be provided to the Mayor and City Councilors, published in the <br /> j Register Guazd, a newspaper of general circulation within the City, posted at four public locations, <br /> ~ and be made available for inspection by interested persons at the office of the City Manager, 777 <br /> ~ Pearl Street, Room 105, the Human Resource and Risk Services Office, 777 Pearl Street, Room 101, <br /> the Public Works Lobby, 858 Peazl Street, and the Eugene Public Library, 100 W 13`" Avenue, all <br /> in Eugene, Oregon, during normal business hours. <br /> I <br /> Administrative Order - 1 <br /> C:\WINDOWS\TEMP1A058-02-12Repeal.wpd <br /> <br />
