r <br /> <br /> v ~ f`~ <br /> ADMINISTRATIVE ORDER NO. 58-02-23 (Amended) <br /> of the <br /> City Manager pro tem of the City of Eugene <br /> 'i <br /> INCREASING OFF-STREET PARKING FEES FOR SPECIAL EVENTS; <br /> RATIFYING THE UNAMENDED FEES; AND REPEALING <br /> ADMINISTRATIVE ORDER N0.53-00-06. <br /> I~ <br /> ! The City Manager pro tem of the City of Eugene finds as follows: <br /> j A. Section 5.040 of the Eugene Code, 1971 authorizes the City Manager to establish <br /> parking areas, time limitations, form of permissible parking, and fees therefor. In accordance with <br /> those procedures, a Parking Fee Schedule and Regulations was adopted by Administrative Order <br /> No.53-00-06 on August 22, 2000, effective October 1, 2000. <br /> i <br /> I <br /> B. On July 22, 2002, Ordinance No. 20260 amending Subsection 5.285(5) of the Eugene <br /> ' Code, 1971 was passed by the City Council and approved by the Mayoz The ordinance eliminated <br /> the maximum rate that can be charged for off-street parking. After considering the applicable criteria <br /> j of Subsection~5.055(n)6. and Subsection 5.285(7) of the Eugene Code, 1971, I find that the charge <br /> ~ for special event parking for events taking place at non-City facilities should be $10.00, and for <br /> events taking place at City facilities should be $5.00. <br /> ~j G I therefore intend to repeal Administrative Order No. 53-00-06 and adopt a new <br /> j Parking Fee Schedule and Regulations containing the amendment referenced above, and by its <br /> adoption, ratify and affirm the unamended fees and regulations contained therein. <br /> i On the basis of these findings, I order that: <br /> 1. Administrative Order No. 53-00-06 and the fees and regulations adopted therein are <br /> repealed effective at midnight on . /~rTitirr, .r a ~ ~ , 2002. <br /> i 2. The Parking Fee Schedule and Regulations, attached as Exhibit A hereto, is adopted <br /> I <br /> effective at 12:01 a.m. on . D~olltem r o2'r , 2002. <br /> 3. Any person aggrieved by this administrative action may appeal this increase in the <br /> special event parking fee by filing a written notice of appeal with the City Manager as provided in <br /> j Section 5.045 of the Eugene Code, 1971, within 30 days of the date this Order is adopted. The <br /> notice of appeal shall be accompanied by the appeal fee established by the City Manager pursuant <br /> to Section 2.020 of the Eugene Code, 1971. <br /> 4.
