based upon evidence that the deviation request meets all of the following criteria: <br /> 3.1 The alternate investigation method will have sufficient geological <br /> investigation to locate, design and construct the proposed facilities for long-term safety, <br /> structural stability and soundness through a comparable or superior design; <br /> 3.2 The alternative will not adversely affect health, public safety and welfare, <br /> and/or operation of the structure(s); and <br /> 3.3 The alternative will not adversely affect maintainability ofthe structure(s). <br /> This Rule shall become effective 30 days from the date that it is adopted as indicated below. <br /> This Rule shall apply only to land use applications submitted after the Rule's effective date. <br /> Dated 3 ~ day of N , 2003. <br /> James R.
