ADMINISTRATIVE ORDER NO.58-03-09-F of the ~ City Manager of the City of Eugene I AMENDMENT TO THE WASTEWATER USER FEE SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER NO.58-02-17-F. The ity Manager of the City of Eugene finds as follows: A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971, authorizes t e City Manager to determine and set fees and charges to be imposed by the City for was water service, regional wastewater service, and stormwater service. B. In accordance with the procedures set forth therein, on June 27, 2003, I issued Admi istrative Order No. 58-03-09, and notified the Mayor and City Councilors that I intended to ncrease the Wastewater User Fee Schedule established by Administrative Order No. 8-02-17-F on June 20, 2002, as set forth in the Notice attached thereto, effective for II bills issued on or after August 1, 2003. C. Notice was also provided to the news media, any person who had requested notice, an to interested governmental agencies (including the United States Environmen al Protection Agency, the Department of Environmental Quality, MWMC, and the Eugene ater & Electric Board). In addition, the Notice was posted at two locations at City Hall on my 1, 2003, and published on two separate occasions in the Register-Guard, a newspape of general circulation within the City, on July 1 and 8, 2003. The Notice was made avail ble for inspection by interested persons at the offices of the Public Works Department 858 Pearl Street, Eugene, Oregon, 97401, during normal business hours (8:00 a.m. t 5:00 p.m., Monday through Friday, exclusive of holidays). D. The Notice provided that written comments would be received for a period of 10 days fro the first date of publication and posting, or at the public hearing to beheld in the Public orks Department, 858 Pearl Street, Eugene, Oregon, 97401, on July 14, 2003, between no nand 1:00 p.m.. No written comments were received at the public hearing or within the ti a or in the manner required by the Notice. E. Pursuant to subsection (1) of Section 6.411 of the Eugene Code, 1971, I have conducted an investigation of the revenue needs of the City in providing these services a d have reviewed the .recommendation of the Metropolitan Wastewater Manageme t Commission (MWMC). F. Based on my investigation and MWMC's recommendation, and the findings set forth he ein, I find that the proposed Wastewater User Fee Schedule is in compliance with the Co ncil's directive that the costs of providing such services be recovered from the Administrati a Order -Page 1
