i <br /> <br /> i <br /> ADMINISTRATIVE ORDER N0.58-03-11-F <br /> of the <br /> City Manager of the City of Eugene <br /> AM NDMENT OF FEES FOR ENGINEERING SERVICES FOR <br /> PRI ATELY CONSTRUCTED PUBLIC IMPROVEMENTS; AND REPEAL <br /> OF MINISTRATIVE ORDER N0.58-01-17-F. <br /> f <br /> The ity Manager of the City of Eugene finds as follows: <br /> i <br /> A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br /> and set fees d charges to be imposed by the City for services, goods, use of municipal property, <br /> and licenses and permits. In accordance with the procedures set forth therein, and the further <br /> authority of ection 7.130 of the Eugene Code, 1971, fees for engineering services for privately <br /> constructed blic improvements were established byAdmirustrative OrderNo. 58-01-17-F on July <br /> 11, 2001. <br /> ~ _ B. Pursuant to that authority, on June 24, 2003, I issued Administrative Order No.58-03- <br /> 11 and notifi d the Mayor and City Council that, effective July 14, 2003, I intended to amend the <br /> fees for engi Bering services for privately constructed public improvements, which were established <br /> by Adminis ative Order No. 58-01-17-F, as set forth in the Notice attached thereto. <br /> C. The Notice was also posted at two locations at City Hall on June 26, 2003, and made <br /> i available for inspection by interested persons at the offices of the City Manager, 777 Pearl Street, <br /> Eugene, Ore on 97401, during normal business hours (8:00 a.m. to 5:00 p.m. Monday through <br /> Friday, excl sive of holidays). The Notice provided that written comments would be received for <br /> a period of 1 days from the date of posting. No comments were received within the time or in the <br /> j I manner requ red by the Notice. <br /> D. I find that amendments to the fees for engineering services for privately constructed <br /> public impro ements are necessary in order to comply with the requirements of Section 7.130 of the <br /> Eugene Cod , 1971, that the fees charged for those services recover the City's costs, including <br /> overhead, a ineering, inspection and review services performed by the City. In determining the <br /> fees, I have onsidered the applicable policies, enactments and directives of the City Council, the <br /> amount char ed for these services by the City in the past, the full costs of providing these services <br /> f supported b the fees, the amounts charged by other comparable providers, the revenue needs of the <br /> City as dete fined by the adopted City budget, and the hourly rates of engineering employees for <br /> the 2003-20 4 fiscal year. <br /> E.
