<br /> i <br /> <br /> ~ ADMINISTRATIVE ORDER NO. 58-04-13 <br /> of the <br /> <br /> I City Manager of the City of Eugene <br /> CONCERNING NOTICE OF INTENDED INCREASE IN STORMWATER <br /> SERVICE CHARGES <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 2 of Ordinance No. 19984 adopted by the Council and approved by <br /> the Mayor on September 28, 1994 established monthly stormwater customer charges <br /> effective November 1, 1994. Section C of Ordinance 19984 provided that future <br /> adjustments to the monthly stormwater customer charges be effected by the City Manager <br /> pursuant to Section 6.411 of the Eugene Code, 1971 (EC), which authorizes the City <br /> Manager to determine and set fees and charges to be imposed by the City for wastewater <br /> service, regional wastewater service, and stormwater service. <br /> B. Pursuant to EC Section 6.411, I have investigated the City's current revenue <br /> needs and cost of operation of the City's stormwater service system. I propose to increase <br /> the user fees far stormwater service, which were established in 1994, asset forth in Exhibit <br /> A attached hereto. The proposed increases are necessary in order to comply with the <br /> Council's directive that the costs of providing such services be recovered from the <br /> beneficiaries of the services, and other applicable policies and directives of the City <br /> Council; are consistent with applicable federal and state regulations; are comparable to the <br /> amounts charged by the City of Springfield and other such service providers for <br /> comparable services; preserve the equity between different classes of ratepayers; and are <br /> based on the proposed budget of the City. <br /> C. Based on that investigation, I intend to increase the stormwater user fees for <br /> stormwater service as set forth in the Notice of Intended Increases in stormwater Service <br /> Charges attached as Exhibit A hereto and incorporated herein by reference. The increase <br /> should be implemented and effective for all bills issued on or after July 1, 2004. <br /> On the basis of these findings, I order that: <br /> 1. Copies of the Notice be provided to the Mayor and City Councilors, the news <br /> media, any person who has requested notice, to interested governmental agencies <br /> (including the United States Environmental Protection Agency, the Department of <br /> Environmental Quality, the Metropolitan Wastewater Management Commission, and the <br /> Eugene Water & Electric Board), posted at two locations at City Hall, published on two <br /> separate occasions in the Register Guard, a newspaper of general circulation within the <br /> City, and be made available for inspection by interested persons at the offices of the Public <br /> Works Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business <br /> hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). <br /> Administrative Order -Page 1 <br /> Q:11NFO1UserFees~Stormwater Fees~2004 Ratesl(MStormwaterFees-1ao (00086906).DOC <br /> <br /> i~ <br /> <br /> I <br /> <br />
