i <br /> ADMINISTRATIVE ORDER N0.58-05-05 <br /> j of the <br /> Airport Manager <br /> CONCERNING NOTICE OF IN'T'ENDED AMENDMENT OF SECTIONS 4, 5, <br /> 13 AND 15 OF THE AIRPORT FEE SCHEDULE; RATIFICATION OF <br /> i <br /> UNAMENDED FEES; AND REPEAL OF ADMINISTRATIVE ORDER NO. <br /> 58-04-22-F. <br /> i <br /> ~ The Airport Manager of the City of Eugene finds as follows: <br /> i <br /> A. Authority is granted to the City Manager of the City of Eugene under Sections 2.440 <br /> tq 2.442 of the Eugene Code, 1971 to set fees and charges for the use of the Eugene Airport. The <br /> City Manager has further delegated that authority to the Airport Manager under Airport Rule 8.4.2. <br /> B. Pursuant to that delegated authority, I intend to amend Sections 4, 5,13, and 15 of the <br /> ?jrport Fee Schedule which was adopted by Administrative Order No. 58-04-22-F on December 23, <br /> 2004 (effective January 1, 2005), by reducing the signatory and non-signatory landing fees in Section <br /> 4; increasing the terminal building rental rates and reducing the security fee in Section 5; adding a <br /> fingerprinting and processing fee for the Alien Flight Student Program to Section 13; and clarifying <br /> j that the replacement fee for security badges in Section 15 includes those stolen, broken or defaced, as <br /> well as lost, as set forth in the Notice of Intended Amendment of Airport Fee Schedule attached as <br /> Exhibit A. <br /> C. After investigating the amounts charged for such services in the past, comparable <br /> rates charged by other airports, applicable user fee policies set by the council, the amounts or rates <br /> and other municipal benefits agreed to by comparable users of the airport in a contract, lease, or <br /> permit, and the revenue needs of the airport, I have determined that Sections 4, 5,13, and 15 of the <br /> j Airport Fee Schedule should be amended, the unamended fees ratified in a new Airport Fee <br /> Schedule, and Administrative Order No. 58-04-22-F repealed. <br /> On the basis of these findings, I order that: <br /> 1. Copies of the Notice be provided to the Mayor and City Councilors, persons who <br /> have requested notice, persons who are currently paying such charges, posted at two locations at the <br /> Airport, published in the Register Guard, a newspaper of general circulation within the City, and be <br /> made available for inspection by interested persons at the office of the Airport Manager, 28855 <br /> Lockheed Drive, Eugene, Oregon, 97402, during normal business hours (8:00 a.m. to 5:00 p.m., <br /> ~ Monday through Friday, exclusive of holidays). <br /> i <br /> <br /> 'I <br /> 2. All persons desiring to comment on the proposed fees shall submit written comments <br /> as set forth in the Notice. After expiration of the comment period, I will by administrative order <br /> establish the fees as proposed, or as modified in response to the comments received. <br /> Dated this 17th day of June, 2005. <br /> Robe P.
