ADMINISTRATIVE ORDER N0.58-OS-07-F <br /> of the <br /> City Manager of the City of Eugene <br /> AMENDMENT OF FEES FOR ENGINEERING SERVICES FOR <br /> PRIVATELY CONSTRUCTED PUBLIC IMPROVEMENTS AND <br /> REPEAL OF ADMINISTRATIVE ORDER N0.58-04-14-F. <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br /> determine and set fees and charges to be imposed by the City for services, goods, use of <br /> municipal property, and licenses and permits. <br /> B. Pursuant to that authority, and the further authority of Section 7.130 of the <br /> Eugene Code, 1971, on June 28, 2005, I issued Administrative Order No. 58-OS-07 and notified <br /> the Mayor and City Council that I intended to amend the fees for engineering services for <br /> privately constructed public improvements, which were established by Administrative Order No. <br /> 58-04-14-F on August 6, 2004. The proposed fee amendments were set forth in the Notice <br /> attached as Ex. A to Administrative Order No. 58-OS-07. <br /> C. The Notice was also posted at two locations at City Hall on June 29, 2005, <br /> published in the Register-Guard on July 2, 2005, and made available for inspection by interested <br /> persons at the offices of the City Manager, 777 Pearl Street, Eugene, Oregon 97401, during <br /> normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). <br /> The Notice provided that written comments would be received for a period of 15 days from the <br /> date of posting and publication. No comments were received within the time or in the manner <br /> required by the Notice. <br /> D. I find that amendments to the fees for engineering services for privately <br /> constructed public improvements are necessary in order to comply with the requirements of <br /> Section 7.130 of the Eugene Code, 1971, that the fees charged for those services recover the <br /> City's costs, including overhead, engineering, inspection and review services performed by the <br /> City. In determining the fees, I have considered the applicable. policies, enactments and <br /> directives of the City Council, the amount charged for these services by the City in the past, the <br /> full costs of providing these services supported by the fees, the amounts charged by other <br /> comparable providers, the revenue needs of the City as determined by the adopted City budget. <br /> E. Based upon the above findings and the findings in Administrative Order No. 58- <br /> 05-07, the fees for engineering services for privately constructed public improvements should be <br /> amended as proposed. <br /> On the basis of these findings, I order that: <br /> <br /> Administrative Order -Page 1 <br /> <br />
