NOTICE OF INTENDED RULEMAKING _ <br /> PROPOSED ADOPTION OF AN AMENDMENT TO THE DESIGN <br /> STANDARDS AND GUIDELINES FOR EUGENE STREETS, <br /> SIDEWALKS, BIKEWAYS AND ACCESS WAYS AS ADOPTED BY <br /> RESOLUTION NO. 4608. <br /> NOTICE IS HEREBY GIVEN that pursuant to the authority contained in Sections <br /> 2.019 and 7.085 of the Eugene Code, 1971, and in Resolution No. 4608, the City Manager of the <br /> City of Eugene, intends to amend the Criteria for Exceptions subsection of the Arterial and <br /> Collector Street Design Standards and Guidelines section of the Design Standards and <br /> Guidelines for Eugene Streets, Sidewalks, Bikeways and Accessways by adding a new Exception <br /> 7 that provides as follows: <br /> 7) For acity-initiated project, the Council decides not to approve a proposed <br /> project design that meets the standards of this chapter, but, after a design process <br /> that includes input from affected property owners and interested persons, the <br /> Council approves a design that the City Engineer determines is safe and <br /> functional. <br /> The proposed amendment is necessary in order to meet design contingencies not <br /> addressed by the current exceptions, and maybe reviewed at the office of the City Engineer, 858 <br /> Pearl Street, Eugene, Oregon 97401, during normal business •hours (8:00 a.m. to 5:00 p.m., <br /> Monday through Friday, exclusive of holidays). <br /> All persons wishing to comment thereon or object thereto must submit their comments or <br /> objections to the City Manager in writing, within 15 days of the date of the first publication <br /> hereof, as indicated below. The City Manager will thereafter adopt the amendment as proposed, <br /> or as modified in response to comments received, to be effective as provided therein. <br /> Dennis M.
