r <br /> ADMINISTRATIVE ORDER N0.58-06-02-F <br /> of the <br /> City Manager of the City of Eugene <br /> INFLATIONARY ADJUSTMENT OF SYSTEMS DEVELOPMENT <br /> CHARGES FOR LOCAL WASTEWATER SYSTEM, STORMWATER <br /> SYSTEM, AND TRANSPORTATION SYSTEM. <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager of the <br /> City of Eugene to determine and set fees and charges to be imposed by the City for services, <br /> goods, use of municipal property, and licenses and permits. EC 7.710(5) authorizes the City <br /> Manager to adopt by administrative order changes to Systems Development Charge (SDC) rate <br /> factors and cost indices. <br /> B. The SDC Methodologies were adopted by Resolution No. 4740 on September 23, <br /> 2002, and have subsequently been amended, most recently by Resolution No. 4795, effective <br /> July 1, 2004. Inflationary adjustments for Local Wastewater System, Stormwater System and <br /> Transportation System SDCs were most recently adopted by Resolution No. 4827, effective <br /> April 18, 2005. <br /> C. In accordance with the procedures set forth in EC 2.020 and 7.710(5), on March <br /> 3, 2006, I issued Administrative Order No. 58-06-02 and notified the Mayor and City Council <br /> that I intended to amend portions of the Systems Development Charges based on the nationa120- <br /> city average Construction Cost Index as published by the Engineering News-Record, by <br /> implementing a 4.6% inflationary increase to the local wastewater system, stormwater system, <br /> and transportation system, as set forth in the Notice attached as Exhibit A to that Order. <br /> D. Notice was also posted at two locations at City Hall on March 10, 2005, published <br /> in the Register-Guard, a newspaper of general circulation within the City, on March 11, 2006, <br /> and made available for inspection by interested persons at the office of the City Engineer, Public <br /> Works Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 <br /> a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). Notice provided that written <br /> comments would be received for a period of 15 days from the date of publication. No comments <br /> were received within the time or in the manner set forth in the Notice. <br /> E. I find that the inflationary adjustments to the Systems Development Charges <br /> should be implemented as proposed and are consistent with adopted policies of the City, in <br /> conformity with applicable state law, authorized by EC 7.710(5), and should be implemented <br /> effective Apri13, 2006. <br /> On the basis of these findings, I order that: <br /> <br /> Administrative Order -Page 1 <br /> <br />
