ADMINISTRATIVE ORDER N0.58-06-04-F <br /> of the <br /> ,City Manager of the City of Eugene <br /> AMENDMENT TO THE WASTEWATER USER FEE <br /> SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER <br /> N0.58-OS-04-F. <br /> <br /> { The City Manager of the City of Eugene finds as follows: <br /> A. Section 6.411 of the Eugene, Code, 1971 (EC), authorizes the City Manager to <br /> determine and set fees and charges to be imposed by the City for wastewater service, regional <br /> wastewater service, and stormwater service. <br /> B. In accordance with the procedures of EC 6.411, I issued Administrative Order No. 58- <br /> 06-04 on Apri121, 2006, and a Notice of Intended Amendment of Wastewater User Fee Schedule. <br /> The Notice was sent to the Mayor and City Councilors as notification of my intention to increase the <br /> fees in the Wastewater User Fee Schedule that had been established by Administrative Order No. 58- <br /> OS-04-F on June 2, 2005. <br /> C. Notice was provided to the news media, any person who had requested notice, and to <br /> interested governmental agencies (including the United States Environmental Protection Agency, the <br /> Department of Environmental Quality, MWMC, and the Eugene Water & Electric Board). In <br /> addition, the Notice was posted at two locations at City Hall on Apri128, 2006, and published on two <br /> ,separate occasions in the Register-Guard, a newspaper of general circulation within the City, on <br /> ' Apri129 and 30, 2006. The Notice was also made available for inspection by interested persons at <br /> 'the offices of the Public Works Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal <br /> business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br /> <br /> I <br /> D. The Notice provided that written comments would be received for a period of ten days <br /> from the first date of publication and posting, and that comments would also be received at the <br /> public hearing to be held in the McNutt Room of Eugene City Hall, 777 Pearl Street, Eugene, <br /> Oregon 97401 on May 9, 2006, between 3 PM and 4 PM. During the public hearing, three attendees <br /> (Charles Biggs, Gary Heldt, and Zach Vishanoffj entered into a question/answer period with City <br /> staff. Gary Heldt, who works at the 4J School District, submitted written comments which are <br /> addressed in the Amendment of Stormwater User fee Schedule Administrative OrderNo. 58-06-03- <br /> F. No changes are being made to the proposed fees as a result of the questions and comments. No <br /> other comments were received at the public hearing or within the time or in the manner provided in <br /> 'the Notice. <br /> E.
