ADMINISTRATIVE ORDER N0.58-06-04 <br /> of the <br /> City Manager of the City of Eugene " <br /> CONCERNING NOTICE OF INTENDED AMENDMENT TO <br /> THE WASTEWATER USER FEE SCHEDULE AND REPEAL <br /> OFADMINISTRATIVE ORDER NO. 58-05-04-F. <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 6.411 of the Eugene, Code, 1971, authorizes the City Manager to determine <br /> and set fees and charges to be imposed by the City for wastewater service, regional wastewater <br /> service, and stormwater service. Pursuant to that authority, on June 2, 2005, I issued Administrative <br /> Order No. 58-OS-04-F amending the Wastewater User Fee Schedule, effective June 12, 2005. <br /> B. In accordance with subsection (1) of Section 6.411 of the Eugene Code,1971, Ihave <br /> conducted an investigation of the revenue needs of the City in providing wastewater services. I <br /> propose to amend the Wastewater User Fee Schedule based on: (1) the amount charged for the <br /> services in the past; (2) the recommendation of the Metropolitan Wastewater Management <br /> Commission (MWMC); (3) applicable federal and state regulations; (4) amounts chazged by the City <br /> of Springfield and other such service providers for comparable services; (5) the revenue needs for <br /> costs related to local and regional sewerage facilities; (6) other rel,~vant adopted policies of the <br /> council; (7) the terms of any applicable intergovernmental agreement relating to wastewater; and (8) <br /> obtaining equity between different classes of ratepayers. <br /> C. Based on my investigation and MWMC's recommendation, Ipropose to amend the <br /> wastewater user fees as set forth in the Notice of Intended Amendment of Wastewater User Fee <br /> Schedule attached as Exhibit A. The amendments should be implemented and effective for all bills <br /> issued on or after July 1, 2006. <br /> On the basis of these findings, I order that: <br /> 1. Copies of the Notice be provided to the Mayor and City Councilors, the news media, <br /> any person who has requested notice, to interested governmental agencies (including the United <br /> States Environmental Protection Agency, the Department of Environmental Quality, the Metropolitan <br /> Wastewater Management Commission, and the Eugene Water & Electric Board), posted at two <br /> locations at City Hall, published on two separate occasions in the Register Guard, a newspaper of <br /> general circulation within the City, and be made available for inspection by interested persons at the <br /> offices of the Public Works Department, 858 Pearl Street, Eugene, Oregon 97401, during normal <br /> <br /> business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). <br /> 2.
