EXHIBIT A <br /> <br /> `Vr., FINDINGS IN SUPPORT OF THE ADOPTION <br /> OF ADMINISTRATIVE ORDER N0.58-06-06-F <br /> Introduction <br /> The City of Eugene has added provisions to Chapter 9 of the Eugene Code (EC), the City of <br /> Eugene's adopted land use code, in order to protect life and property from flood and drainage <br /> hazards, reduce the impacts that urbanization is having on the City's water quality, protect waterways <br /> in the headwater areas from erosive affects of increases in stormwater runoff, protect the City's <br /> stormwater system from oil and grease from stormwater runoff, and prevent stormwater pollution by <br /> eliminating pathways that may introduce pollutants into stormwater (hereinafter referred to as "the <br /> Stormwater Regulations"). The Stormwater Regulations will require that developers comply with <br /> standards that are based, in part, on facilities and methodologies set forth in the Stormwater <br /> Management Manual. The Stormwater Regulations provide that the Stormwater Management <br /> ~Vlanual will be adopted by the City in the manner set forth in EC 2.019, City Manager - <br /> Administrative and Rulemaking Authority and Procedures. <br /> This administrative order that adopts the Stormwater Management Manual is a not a land use <br /> regulation. However, the administrative order, that implements the City's adopted land use code, is <br /> potentially a land use decision. The City recognizes that state law does not require a local <br /> government to show compliance with the Statewide Planning Goals when making an administrative <br /> land use decision. However, because the administrative order implements an acknowledged land use <br /> regulation (the City's adopted land use code), the findings set forth below are intended to <br /> demonstrate that the standards are consistent with the Statewide Planning Goals. <br /> Findings of Consistency with the Statewide Planning Goals <br /> (1) The administrative order is consistent with applicable statewide planning goals adopted by <br /> the Land Conservation and Development Commission. <br /> Goal 1-Citizen Involvement. To develop a citizen involvementprogram that insures the opportunity <br /> ,for citizens to be involved in all phases of the planning process. <br /> The City has acknowledged provisions for citizen involvement that insure the opportunity for <br /> citizens to be involved in all phases of the planning process and set out requirements for such <br /> involvement. The action taken did not amend the citizen involvement program. <br /> Throughout the Stormwater Management Manual drafting process, the City provided numerous <br /> opportunities for citizen involvement. The City initiated the public involvement in 1999 when it <br /> convened afourteen-member Stormwater Department Advisory Committee (DAC) to provide <br /> feedback to Eugene Public Works on the results of the Stormwater Basin Planning efforts.
