<br /> City Manager of the City of Eugene
<br /> ADOPTING THE STORMWATER MANAGEMENT MANUAL.
<br /> The City Manager of the City of Eugene finds as follows:
<br /> A. Section 2.019 of the Eugene Code, 1971 (EC) authorizes the City Manager to adopt
<br /> rules for administration and implementation of any provisions of that Code. In addition, EC 9.6790,
<br /> added to the Code by Ordinance No. 20369 adopted by the City Council on June 12, 2006, requires
<br /> that the City Manager adopt, in accordance with EC 2.019, a Stormwater Management Manual. The
<br /> Stormwater Management Manual may contain forms and facility agreements and shall include
<br /> requirements that are consistent with delineated goals.
<br /> B. In accordance with the procedures set forth therein, on May 2, 2006, the City Manager
<br /> issued Administrative Order No. 58-06-06 proposing the adoption of the Stormwater Management
<br /> Manual. Notice was posted at the City Manager's office, 777 Pearl Street, at Public Works
<br /> Engineering, 858 Pearl Street, and at the Eugene Library Reference Center, and was published in the
<br /> Register Guard, a newspaper of general circulation on May 7, 8, 9, 10 and 11, 2006. The proposed
<br /> Stormwater Management Manual was made available for review at the City Manager's Office, at
<br /> Public Works Engineering, and at the Eugene Library Reference Center. Additionally, notice of the
<br />
<br /> " proposed adoption of the Stormwater Management Manual was sent to the Department of Land
<br /> Conservation and Development on March 28, 2006.
<br /> C. The notice provided that interested persons could submit written comments thereon
<br /> for a period of thirty (30) days from the first date of publication, or at the public hearing to be held
<br /> on June 8, 2006, at 4:00 p.m. at 858 Pearl Street, Lyle Conference Room, Eugene, Oregon. Written
<br /> comments were received from Rob Handy, Becky Riley, Jerry Finigan, Teresa Damron, Kate Pere,
<br /> Ellen Hyman, Rachel DeBuse, Tammie Stark, Megan Kemple, Jenya Lemeshow, and Bruce H.
<br /> Anderson.
<br /> D. The following comments were received in response to this notice, or at the June 8,
<br /> 2006 public hearing, to which I make the following specific findings:
<br /> Comment 1: Eugene needs to do more to preserve natural drainage systems in the
<br /> urban area.
<br /> Finding: Concern was expressed during the stormwater development standards ordinance
<br /> adoption and manual review that, upon development, roadside swales and open waterways would be
<br /> replaced with engineered (piped) systems for conveying stormwater. Residents stated that, given
<br /> their multiple benefits, roadside ditches, swales and open waterways should be preserved and utilized
