<br /> I <br /> <br /> i <br /> ADMINISTRATIVE ORDER NO. 58-06-08-F <br /> of the <br /> City Manager of the City of Eugene <br /> AM NDMENT OF FEES FOR ENGINEERING SERVICES FOR <br /> PRI ATELY CONSTRUCTED PUBLIC IMPROVEMENTS AND <br /> REP AL OF ADMINISTRATIVE ORDER N0.58-05-07-F. <br /> The ity Manager of the City of Eugene finds as follows: <br /> A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br /> determine a d set fees and charges to be imposed by the City for services, goods, use of <br /> municipal p operty, and licenses and permits. <br /> B. Pursuant to that authority, and the further authority of Section 7.130 of the <br /> Eugene Co e, 1971, on June 9, 2006, I issued Administrative Order No. 58-06-08 and notified <br /> the Mayor nd City Council that I intended to amend the fees for engineering services for <br /> privately co structed public improvements which had been established by Administrative Order <br /> No. 58-OS-0 -F on July 19, 2005. The proposed fee amendments were described in the Notice <br /> attached as xhibit A to Administrative Order No. 58-06-08. <br /> <br /> t <br /> C. The Notice was also posted at two locations at City Hall on June 16, 2006, and <br /> made availa le for inspection by interested persons at the offices of the City Manager, 777 Pearl <br /> Street, Eug e, Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m. Monday <br /> through Fri ay, exclusive of holidays). In addition, a Notice with respect to fees in the amount <br /> of $250 or ore was published in the Register-Guard on June 17, 2006. Notice provided that <br /> written co ments would be received for a period of 15 days from the date of posting and <br /> publication. No comments were received within the time or in the manner required by the <br /> Notice. <br /> D. I find that amendments to the fees for engineering services for privately <br /> constructed public improvements are necessary in order to comply with the requirements of <br /> Section 7.1 0 of the Eugene Code, 1971, that the fees charged for those services recover the <br /> City's costs including overhead, engineering, inspection and review services performed by the <br /> City. In termining the fees, I have considered the applicable policies, enactments and <br /> directives o the City Council, the amount charged for these services by the City in the past, the <br /> full costs o providing these services supported by the fees, the amounts charged by other <br /> comparable providers, and the revenue needs of the City as determined by the adopted City <br /> <br /> f budget. <br /> E. Based upon the above findings and the findings in Administrative Order No. 58- <br /> 06-08, the f es for engineering services for privately constructed public improvements should be <br /> amended as roposed. <br /> Administrativ Order -Page 1 <br /> <br />
