ADMINISTRATIVE ORDER N0.58-07-06 <br /> of the <br /> City Manager of the City of Eugene <br /> CONCERNING NOTICE OF INTENDED AMENDMENT OF FEES FOR <br /> ENGINEERING SERVICES FOR PRIVATELY CONSTRUCTED PUBLIC <br /> IMPROVEMENTS, AND REPEAL OF ADMINISTRATIVE ORDER NO. <br /> 58-06-08-F. <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br /> determine and set fees and charges to be imposed by the City for services, goods, use of <br /> <br /> municipal property, and licenses and permits. <br /> B. In accordance with those procedures, and the further authority of Section 7.130 of <br /> the Eugene Code, 1971, I intend to amend the Engineering Services Fee Schedule that was <br /> adopted by Administrative Order No. 58-06-08-F on July 7, 2006, by discontinuing certain <br /> services and increasing the fees as indicated on the Notice of Intended Increase in Engineering <br /> Services Fee Schedule which is attached as Exhibit A. The fee amendments are necessary in <br /> order to comply with the requirements of Section 7.130 of the Eugene Code, 1971, that the fees <br /> charged cover the costs, including overhead, of engineering, inspection and review services <br /> performed by the city on all private or public improvements not engineered by the City. <br /> C. Annual review of the costs of providing engineering services has been completed <br /> and the proposed fees have been calculated based on the results of that review. Additionally, in <br /> determining the proposed fees set forth in Exhibit A, I have considered the applicable policies, <br /> enactments and directives of the City Council, the amount charged for these services by the City <br /> in the past, the full costs of providing these services supported by the fees, the amounts charged <br /> by other comparable providers, and the revenue needs of the City as determined by the adopted <br /> City budget. <br /> On the basis of these findings, I order that: <br /> 1. Copies of the Notice attached as Exhibit A be provided to the Mayor and City <br /> Councilors, posted at two locations at City Hall, and be made available for review by interested <br /> persons at the offices of the City Manager, 777 Pearl Street, Eugene, Oregon 97401, during <br /> normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). <br /> In addition, a copy of the Notice attached as Exhibit B, which identifies those fees that are $250 <br /> or greater, be published in the Register Guard, a newspaper of general circulation within the <br /> City. <br /> 2. All persons desiring to comment on the proposed fee amendments shall submit <br /> written comments as described in the Notice. After expiration of the comment period, I will <br /> establish by administrative order the fees as proposed or as modified in response to the <br /> comments received, effective July 8, 2007; incorporate any unamended fees established by <br /> Administrative Order -Page 1 of 2 <br /> <br />
