ADMINISTRATIVE ORDER N0.58-07-06-F <br /> of the <br /> City Manager of the City of Eugene <br /> AMENDMENT OF FEES FOR ENGINEERING SERVICES FOR <br /> PRIVATELY CONSTRUCTED PUBLIC IMPROVEMENTS, AND <br /> REPEAL OF ADMINISTRATIVE ORDER N0.58-06-08-F. <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br /> determine and set fees and charges to be imposed by the City for services, goods, use of <br /> municipal property, and licenses and permits. <br /> B. Pursuant to that authority, and the further authority of Section 7.130 of the <br /> Eugene Code, 1971, on June 4, 2007, I issued Administrative Order No. 58-07-06 and notified <br /> the Mayor and City Council that I intended to amend the fees for engineering services for <br /> privately constructed public improvements which had been established by Administrative Order <br /> No. 58-06-08-F on July 7, 2006. The proposed fee amendments were described in the Notice <br /> attached as Exhibit A to Administrative Order No. 58-07-06. <br /> C. The Notice was also posted at two locations at City Hall on June 16, 2007, and <br /> made available for inspection by interested persons at the offices of the City Manager, 777 Pearl <br /> Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m. Monday <br /> through Friday, exclusive of holidays). In addition, a Notice with respect to fees in the amount <br /> of $250 or more was published iri the Register-Guard on June 13, 2007. Notice provided that <br /> written comments would be received for a period of 15 days from the date of posting and <br /> publication. No comments were received within the time or in the manner required by the <br /> Notice. <br /> D. I find that amendments to the fees for engineering services for privately <br /> constructed public improvements are necessary in order to comply with the requirements of <br /> Section 7.130 of the Eugene Code, 1971, that the fees charged for those services recover the <br /> City's costs, including overhead, engineering, inspection and review services performed by the <br /> City. Determination of the fees was made after annual review of the costs of providing <br /> engineering services and considering the applicable policies, enactments and directives of the <br /> City Council, the amount charged for these services by the City in the past, the full costs of <br /> providing these services supported by the fees, the amounts charged by other comparable <br /> providers, and the revenue needs of the City as determined by the adopted City budget. <br /> E. Based upon the above findings and the findings in Administrative Order No. 58- <br /> 07-06, the fees for engineering services for privately constructed public improvements should be <br /> amended as proposed. <br /> On the basis of these findings, I order that: <br /> <br /> Administrative Order -Page 1 of 2 <br /> <br />
