r <br /> ADMINISTRATIVE ORDER N0.58-07-03-F <br /> of the <br /> City Manager of the City of Eugene <br /> IN ATIONARY ADJUSTMENT OF SYSTEMS DEVELOPMENT <br /> CH RGES FOR LOCAL WASTEWATER SYSTEM, STORMWATER <br /> SYS EM, AND TRANSPORTATION SYSTEM, AND REPEALING <br /> AD INISTRATIVE ORDER NOS. 58-04-04-F AND 58-06-02-F. <br /> i. <br /> The City Manager of the City of Eugene finds as follows: <br /> i <br /> A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager of the <br /> City of Eu ene to determine and set fees and charges to be imposed by the City for services, <br /> ~ goods, use f municipal property, and licenses and permits., EC 7.710(5) authorizes the City <br /> " Manager to adopt by administrative order changes to Systems Development Charge (SDC) rate <br /> factors and ost indices. <br /> i <br /> B. The SDC Methodologies were adopted by Resolution No. 4740 on September 23, <br /> 2002, and ave subsequently been amended, most recently by Resolution No.4876 effective on <br /> July 12, 20 6. Inflationary adjustments for Local Wastewater System, Stormwater System and <br /> Transporta on System SDCs were most recently adopted by Administrative Order No. 58-06-02- <br /> F, effective April 3, 2006, and an inflationary adjustment of SDC rates for Regional Wastewater <br /> System w adopted by Resolution No. 4883, effective August 1, 2006. <br /> ~ ~ C. In accordance with the procedures set forth in EC 2.020 and 7.710(5), on March <br /> ~ 5, 2007, I 'ssued Administrative Order No. 58-07-03 and notified the Mayor and City Council <br /> that I inten ed to amend portions of the Systems Development Charges based on the nationa120- <br /> city avera a Construction Cost Index as published by the Engineering News-Record, by <br /> ~ implementi g a 3.1 % inflationary increase to the Local Wastewater System, Stormwater System, <br /> and Transp rtation System, as set forth in the Notice attached as Exhibit A to that Order. <br /> D. Notice was also posted at two locations at City Hall and published in the Register- <br /> Guard, a n wspaper ofgeneral circulation within the City, on March 9, 2007. In addition, Notice <br /> was provi to persons who requested such notice, and was made available for inspection by <br /> interested ersons at the office of the City Engineer, Public Works Department, 858 Pearl Street, <br /> Eugene, O egon 97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday through <br /> Friday, ex lusive of holidays). Notice provided that written comments would be received for a <br /> period of 1 days from the date of publication. No comments were received within the time or in <br /> the mane set forth in the Notice. <br /> E.
