r ADMINISTRATIVE ORDER N0.58-07-03-F of the City Manager of the City of Eugene IN ATIONARY ADJUSTMENT OF SYSTEMS DEVELOPMENT CH RGES FOR LOCAL WASTEWATER SYSTEM, STORMWATER SYS EM, AND TRANSPORTATION SYSTEM, AND REPEALING AD INISTRATIVE ORDER NOS. 58-04-04-F AND 58-06-02-F. i. The City Manager of the City of Eugene finds as follows: i A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager of the City of Eu ene to determine and set fees and charges to be imposed by the City for services, ~ goods, use f municipal property, and licenses and permits., EC 7.710(5) authorizes the City " Manager to adopt by administrative order changes to Systems Development Charge (SDC) rate factors and ost indices. i B. The SDC Methodologies were adopted by Resolution No. 4740 on September 23, 2002, and ave subsequently been amended, most recently by Resolution No.4876 effective on July 12, 20 6. Inflationary adjustments for Local Wastewater System, Stormwater System and Transporta on System SDCs were most recently adopted by Administrative Order No. 58-06-02- F, effective April 3, 2006, and an inflationary adjustment of SDC rates for Regional Wastewater System w adopted by Resolution No. 4883, effective August 1, 2006. ~ ~ C. In accordance with the procedures set forth in EC 2.020 and 7.710(5), on March ~ 5, 2007, I 'ssued Administrative Order No. 58-07-03 and notified the Mayor and City Council that I inten ed to amend portions of the Systems Development Charges based on the nationa120- city avera a Construction Cost Index as published by the Engineering News-Record, by ~ implementi g a 3.1 % inflationary increase to the Local Wastewater System, Stormwater System, and Transp rtation System, as set forth in the Notice attached as Exhibit A to that Order. D. Notice was also posted at two locations at City Hall and published in the Register- Guard, a n wspaper ofgeneral circulation within the City, on March 9, 2007. In addition, Notice was provi to persons who requested such notice, and was made available for inspection by interested ersons at the office of the City Engineer, Public Works Department, 858 Pearl Street, Eugene, O egon 97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, ex lusive of holidays). Notice provided that written comments would be received for a period of 1 days from the date of publication. No comments were received within the time or in the mane set forth in the Notice. E. I find that the inflationary adjustments to the Systems Development Charges are consistent 'th adopted policies of the City, in conformity with applicable state law, authorized by EC 7.7 0(5), and should be implemented as proposed effective Apri13, 2007.
