AGENDA ITEM SUMMARY
December 4, 2006
TO: Eugene Planning Commission
FROM: Therese Walch, Public Works Department, Wastewater Division
SUBJECT: Introduction to Water Quality Protected Waterways Proposal
ACTION REQUESTED: None. Following work session and public hearing scheduled for
January 23, 2007, the Planning Commission will be asked to recommend to the City Council
approval of land use code amendments that would implement water quality protections for.
certain local waterways.
BRIEFING STATEMENT: On December 11, 2006, in preparation for a Planning
Commission work session and public hearing scheduled for January 2007, staff will present an
introduction to the proposed waterway protections for water quality. The introduction will
include background on the federal Clean Water Act, Statewide Planning Goal 6 and Eugene's
Comprehensive Stormwater Management Plan, as well as the distinctions between the water
quality waterways proposal and the recently adopted Goa15 Water Resources Conservation
Overlay code amendments.
BACKGROUND: Several of our local waterways are not meeting water quality standards,
and are at risk from additional development impacts that would further degrade water quality.
In order to prevent additional impacts .and in order to comply with federal water quality
requirements to bring these impaired waterways back into compliance, staff will be proposing
adoption of regulations that accomplish the following objectives: 1) protect waterways that
have been identified by the state as water quality impaired; 2) protect waterways_that drain
directly into a water quality impaired waterway; and 3) protect waterways that are particularly
sensitive to adverse impacts from development. The proposed water quality regulations are
also intended to meet the requirements of Statewide Planning Goa16 to maintain and improve
the quality of the air, water, and land resources of the State. Additionally, the proposed
regulations are necessary to meet local comprehensive stormwater management goals and to
maintain and improve the water quality of waterways throughout the City.. The proposed
regulations are one element of the city's overall program for reducing urban stormwater

.pollution.
ITEMS UNDER SEPARATE COVER:
A.
