Mark clarified the status of the Delta Ponds project as regards the Corps' funding and he notified us that as <br /> of 5 P.M. yesterday the Corps would cease working on the project until they get more funding. Mark described two <br /> possible scenarios under which the Corps will resume working on the project: <br /> 1) The project is funded for the next fiscal year, with funds being available in October. While the Delta Ponds project <br /> is well underway, it is not under construction, so it will not be in the highest priority for funding. <br /> 2) Some funds become available as a result of a problem on an existing construction project. If funds are available <br /> under this scenario it would likely be at the end of the construction season -Mark mentioned September. Any funds that <br /> become available at that time would be dedicated to the invasive species contract work with the goal of getting some <br /> contract out, however small, so that the project would officially be under construction and therefore in the highest priority <br /> category for additional funding. <br /> By my reading of the Project Cooperation Agreement (Article XIV, B.), if the Corps wants to discontinue our fund matching <br /> agreement because of their funding problem, they must notify the City in writing that appropriations are not available for <br /> <br /> the project. The PCA remains in effect for 60 days following the notification, at which time it may be terminated or <br /> suspended. I take this language to mean that the agreement, and the obligation to match City expenses, is in effect for 60 <br /> days past receipt of written notice of the funding problem. If the Corps proceeds along this path I suggest that we verify <br /> <br /> this approach with the City Attorney and then maintain the momentum that we have gained and proceed with permit <br /> applications, design refinements and invasive species work, at least until the PCA is suspended or terminated. If we <br /> continue our work now we will be in a much better position to start up again in October if funds become available. <br /> Scott and Mark: Please let Michelle or me know if you have additional info or if this analysis is off the mark.
