BEFORE THE HEARINGS OFFICIAL OF THE CITY OF EUGENE, OREGON <br /> Final Decision and Order in Z 03-5 <br /> The Hearings Official of the City of Eugene finds as follows: <br /> 1. The; following application for a zone change was submitted: <br /> Assessor's Map: 17-04-24-10; Tax Lots:. 800 and 1600 <br /> Request for a change in zone from R-2/PD, Medium-Density Residential <br /> with Planned Unit Development overlay, to PL Public Land <br /> ..Applicant: - City of Eugene <br /> The application was initiated and submitted in accordance-with EC <br /> Section 9.7010 et seq. Timely and sufficient notice of the zone change <br /> request hearing-under EC Section 9.7315 has been provided. <br /> 2. On January 28, 2004, a public hearing on the zone change request was <br /> held. The Planning Department staff notes and recommendation, together <br /> with the written materials submitted into the record and testimony of <br /> .persons testifying at the hearing public hearing, have been considered and <br /> are a part of the record of this proceeding. <br /> 3. Further consideration has been given to and administrative notice taken of <br /> the provisions of the Eugene-Springfield Metropolitan Area General Plan. <br /> and all applicable special purpose/functional plans, planning-related <br /> policies, neighborhood refinement plans, and community plans as set forth <br /> in the Metro Plan. <br /> 4. On the basis of this record; the requested zone change from R-2/PD to PL <br /> is found consistent with the criteria set forth at Eugene Code Section <br /> 9:8865: This general-finding is supported by the specific findings of the <br /> Planning Division Staff Report for the requested zone change, dated <br /> January 16, 2004, which is adopted and incorporated herein, and which <br /> establishes that the requested zone change to PL complies with each <br /> applicable approval criterion. <br /> NOW, THEREFORE, based upon the above findings and the "record in this proceeding, <br /> IT IS HEREBY ORDERED THAT: <br /> The application for zone change from R-2/PD, Medium-Density Residential with Planned <br /> Unit Development overlay, to PL, Public Land, is APPROVED. <br /> Approval dated February 9, 2004. <br /> <br /> FINAL DECISION AND ORDER- Z 03-OS - page I <br /> <br />
