COREY Kurt A <br /> From: BERRIAN Pam C <br /> Sent: Tuesday, March 29, 2005 9:05 AM <br /> To: SVENDSEN Glen L; COYLE Tom G; COREY Kurt A <br /> Cc: KOLB Randy C; TAYLOR Dennis M; MILLER Dawna A; CARLSON Jim R <br /> Subject: RE: Cell tower fees -Eugene process and files <br /> Hi all - yes, I work with Barbara Novak (CAO) on contracts (we always use our own, never use the carrier's) and <br /> appropriate facility staff (whomever manages the facility that a cell carrier wishes to use), and the revenue is allocated to <br /> the'fund that supports the facility', per Execs 1998 policy (attached). <br /> Through professional associations, I keep pretty good track of fair and appropriate fees to charge for use of City property <br /> although each case is unique because there is no federal barriers re: use of private propriety, and City owned buildings <br /> and land are not public rights of way per se, which IS addressed by the Fed Telecom Act of 1996. <br /> Eugene does have Ord 20078 cell tower zoning and siting ordinance which does set the parameters for placement in all <br /> areas but the rights of way, so within that local law, City Facility managers determine the placement, conditions, and fees - <br /> or they can just say no, thank you. I merely coordinate the process. Staff do try hard to site cell facilities on City property <br /> not only for the revenue of course but also because the council values co-locations and mitigation of single monopoles <br /> (especially in residential areas) and we'll often give a price break to accomplish that (e.g., siting a facility on a street pole <br /> next to the cemetery at 49th and Willamette when a monopole could likely have been legally sited in the middle of that <br /> residential area). <br /> I have contract files on tower facilities at Wastewater (ATT and Sprint), underground fiber in the ridgeline park area, <br /> several co-locations on street lights, a pending co-location on a ball field light, a monopole at the Airport. The County uses <br /> their Publis Works property at Delta for a pole. EWEB allows co-locations on several electric poles and their water tower. <br /> There are also pay phones in City buildings and at the Airport for which 'rent' is paid.
