PUBLIC W S DEPARTMENT • 858 PEARL • EUGENE, OREGON 97401 <br /> NEWS RELEASE <br /> July 15, 987 <br /> <br /> i <br /> CONTACT: Larry Reed, Building Official, 687-5217 <br /> Marsha Miller, Code Analyst, 687-5224 <br /> FOR IMMEDIATE RELEASE <br /> CITY WILL NOT SEEK ENFORCEMENT ACTION AGAINST ASTER <br /> The ity of Eugene Building Safety Division has received an advisory <br /> opinion f om the city procesutor's office regarding the banner on the Aster <br /> Publishin building at 8th and Willamette Street and has decided not to seek <br /> enforceme t action against Aster. <br /> <br /> ~ Acco ding to Larry Reed, city building official, city attorneys analyzed <br /> the use o banners as defined in the Eugene sign code, section 8.630, and <br /> found the code does not treat non-commercial signs in a uniform manner. "The <br /> <br /> j attorneys have found some problems in the ordinance concerning non-commercial <br /> <br /> i <br /> signs," s id Reed. "Only banners that announce community events, conventions, <br /> or confer nces are allowed under the ordinance and all other banners are <br /> <br /> j prohibite According to the attorney's analysis, the non-commercial standard <br /> will be d'fficult to uphold because it does not completely ban all banners, <br /> but has a ceptions for certain types." <br /> Reed said city staff will review the section and begin a process to <br /> amend the ordinance. <br /> The ity received a complaint from a downtown business owner about <br /> the sign n June 4, and sent a notification letter to Ed Aster asking him <br /> more <br /> <br /> i <br /> <br /> I <br /> <br />
