(Contractor) <br /> CONTRA T NO.: 2008-00403 <br /> EFFECTI E <br /> DATE: January 21, 2008 <br /> RECITALS <br /> A. Cont actor is engaged in the business of wastewater construction, and has obtained and <br /> curr ntly holds all licenses, permits, certifications, bonds or other authorization required by <br /> Fed ral, State or local law or regulations to engage in such business. <br /> B. City esires to engage Contractor to perform the services described in the attached Exhibit <br /> C (th "Services"). Contractor has represented that it is qualified to perform the Services, <br /> and esires to enter into this contract with City on the terms set forth below. <br /> AGREEMENT <br /> 1. Eng Bement. City hereby engages Contractor to perform the Services, and Contractor <br /> agre s to perform the Services, according to the terms and conditions set forth herein and <br /> in th following exhibits: <br /> Ex ibit A -City of Eugene Standard Contract Provisions <br /> Ex ibit B -Scope of Services <br /> Ex ibit C -Quote from Contractor <br /> 2. Ter .The Services of this contract shall be completed by February 8, 2008 unless earlier <br /> termi ated in accordance with paragraph 16. <br /> 3. Con ideration. As consideration for performance of the Services, City shall pay <br /> Cont actor $18,865, as bid by Contractor and described in Exhibit C, plus or minus <br /> modi ications requested by City and provided by Contractor at the hourly rate bid. <br /> Pay ent shall be made not later than 30 days after the last day of the month in which the <br /> Servi es were performed. <br /> <br /> 4. Equi ment. Contractor shall provide all materials, equipment, supplies or other items <br /> requi ed for performance of the Services. <br /> 5. Cont act Administration.
