4:Department of Environmental Quality <br /> LAND USE COMPATIBILITY STATEMENT (LUGS) z <br /> WHAT IS A LUGS? e Land Use Compatibility Statement is the process used by the DEQ to determine whether DEQ l t, <br /> permits and other appr vals affecting land use are consistent with local government comprehensive plans. ~'s <br /> WHY IS A LUGS RE UIRED? Oregon law requires state agency activities that impact land use be consistent with local ~ <br /> co~prehensive plans. EQ Oregon Administrative Rules (OAR) Chapter 340, Division 18 identifies agency activities or programs <br /> that significantly affect d use and must have a process for determining local plan consistency. Slate of Oregon <br /> Deparhnent of <br /> WHEN IS A LUGS QUIRED? A LUGS is required for nearly all DEQ permits and certain approvals of plans or related Environmental <br /> activities that affect lan use. These permits and activities are listed on p. 2 of this form. A single LUGS can be used if more than l~uahty <br /> one DEQ petmit/approv 1 is being applied for concurrently. <br /> A permit modification quires a LUGS when any of the following applies: <br /> I . Physical exp sion on the property or proposed use of additional land; <br /> 2. A significant ncrease in discharges to water; <br /> 3. A relocation f an outfall outside of the source property; or <br /> 4. Any physical hange or change of operation of an air pollutant source that results in a net significant emission rate increase as <br /> defined in O R 340-200-0020. <br /> A hermit renewal requi a LUGS if one has not previously been submitted, or if any of the above modification factors apply. <br /> H(DW TO COMPLET A LUGS: <br /> Std Who Does It What Happens <br /> I' Applicant Completes Section 1 of the LUGS and submits it to the appropriate city or county planning office. <br /> 2' City or County Completes Section 2 of the LUGS by determining if the activity or use meets all local planning requirements, and <br /> Planning Office returns to the applicant the signed and dated LUGS form with findings of fact for any local reviews or necessary <br /> planning approvals. <br /> 3, Applicant Includes the completed LUGS with Endings of fact with the DEQ permit or approval submittal application to the <br /> DE . <br /> W>}iERE TO GET HE P: For questions about the LUGS process, contact the DEQ staffresponsiblefnr processing the permit/approval. <br /> Headquarters and region staff may be reached using DEQ's toll-free telephone number 1-800-452-4011.
