result of any violation by Contractor of the terms of this contract, including a determination by City <br />that Contractor has not progressed satisfactorily with the Work in accordance with specifications. <br />12. Preference For Goods and Services. <br />12.1 Contractor shall use recyclable products to the maximum extent economically feasible in the <br />performance of the contract work set forth in this document. Recycled products include all <br />materials, goods and supplies, not less than 50 percent of the total weight of which consists of <br />--~ -secondary and post consumer waste wig not less than 10 percent of its total weight consisting -- <br />ofpost consumer waste, as well as any product that could have been disposed of as a solid <br />waste, having completed its life cycle as a consumer item, but otherwise refurbished for reuse <br />without substantial alteration of the product's form <br />12.2 In perfornance of the Work, Contractor shall prefer materials that have been manufactured or <br />produced in the state of Oregon, if price, fitness, availability and quality aze otherwise equal. <br />13. Foreign Contractor. If Contractor is not domiciled in or registered to do business in the state of <br />Oregon, and the Contract Sum exceeds $10,000, City shall not make final payment to Contractor until <br />Contractor complies with the requirements of ORS 279.021(2xa) and provides City with copies of all <br />forms provided to the Department of Revenue. <br />14. Other Obligations. Pursuant to the provisions of ORS 279.312, Contractor shall: <br />14.1 Make payment promptly, as due, to all persons supplying to Contractor labor or material for <br />the prosecution of the Work. <br />14.2 Pay all contributions or amounts due the Industrial Accident Fund from Contractor incurred in <br />the performance of the Work. <br />14.3 Not permit any lien or claim to be filed or prosecuted against the City or any subdivision or <br />agency or employee thereof on account of any labor or materials furnished pursuant to the <br />contract. <br />14.4 Pay to the Oregon Department of Revenue all sums withheld from employees pursuant to ORS <br />316.167. <br />15. Payment of Medical Care. Contractor shall promptly pay as due to any person, partnership, <br />association or corporation famishing medical, surgical and hospital care or other needed care and <br />attention, incident to siclaiess or injury, to the employees of Contractor, all sums which Contractor <br />agrees to pay for such services and all money and sums which Contractor collected or deducted from <br />wages of its employees pursuant to any law, contract or agreement for the purpose of providing or <br />paying for such service. <br />16. Maximum Hours. Contractor shall not require or permit any person to labor more than the hours <br />permitted under ORS 279.334. <br />Public Improvement Contract (Comp}-Page 4 <br />(Revised April 1998) <br />
