The City was further to retain easements for public <br />acCessway (bike/ped paths) and the local pump station. We are now routing for your review and execution by Dennis, the <br />following three documents: <br />1. Public Accessway Easement, including attachments illustrating the areas. This document is being conveyed from the <br />Ciry of Eugene to the City of Eugene and will be referenced as a reservation in the Bargain and Sale Deed from the City to <br />MV MC. <br />2. ~jNastewater Easement for the local pump station, also with an attached map illustrating the area. This will also be <br />init~ally conveyed from the City of Eugene to the City of Eugene and reserved in the Bargain and Sale Deed to the MWMC. <br />3. ',The Bargain and Sale Deed from the City of Eugene to MWMC, with map and aerial illustrating the subject. This <br />document includes the reservation verbiage for the above two easements. <br />All three of these documents need to be signed by Dennis and his signature notarized. The executed documents can be <br />returned to me to coordinate the exchange of the Bargain and Sale Deed for the Street Deed with MWMC. <br />Thy forth conveyance document is the Street Deed to convey the additional River Avenue street right of way from MWMC <br />the City of Eugene, which is being sent to MWMC for their execution. The City is to pay MWMC for the street right of <br />way being acquired and it has been agreed MWMC will pay the future street assessments for their frontage of the River <br />Avenue Project. <br />Please do not hesitate to contact us if you have questions or wish further clarification. Jerry has been involved in the <br />intergovernmental discussions and agreements with MWMC and Springfield regarding the proposed transfers. I believe <br />Pefer was the staff contact at the July 10 Council meeting pertaining to the transfers, and Michelle and I have been <br />coordinating the right of way acquisition needs and preparation of conveyance documents and corresponding legal <br />descriptions. <br />Thpnk you.
