TRADE SERVICES CONTRACT <br /> (Non-Facility) <br /> <br /> ~irr . <br /> BETWEEN: The City of Eugene, an Oregon <br /> Municipal Corporation (City) <br /> AND: Trillium Gardens (Contractor) <br /> CONTRACT NO.: 2003-05329 <br /> EFFECTIVE <br /> DATE: April 10, 2003 <br /> RECITALS <br /> A. Contractor is engaged in the business of seedling grow-out, and has obtained and currently <br /> holds all licenses, permits, certifications, bonds or other authorization required by Federal, <br /> State or local law or regulations to engage in such business. <br /> B. City desires to engage Contractor to perform the services described in the attached Exhibit <br /> B (the "Specifications"). Contractor has represented that it is qualified to perform the <br /> Services, and desires to enter into this contract with City on the terms set forth below. <br /> AGREEMENT <br /> 1. Engagement. City hereby engages Contractor to perform the Services, and Contractor <br /> agrees to perform the Services, according to the terms and conditions set forth herein and in <br /> the following exhibits: <br /> Exhibit A -City of Eugene Standard Contract Provisions <br /> Exhibit B -City of Eugene RFB No. 2003-200098 <br /> Exhibit C -Vendor's Response to RFB No. 2003-200098 (will be attached after award) <br /> 2. Time of Commencement and Completion. Contractor will commence the Work not later <br /> than 10 days after City gives it's written notice to proceed, and shall complete the Work <br /> within the time stated in the bid proposal. <br /> 3. Contract Sum. The Contract Sum is $19,252.50, which consists of unit prices bid by <br /> Contractor multiplied by estimated quantities, together with lump sum amounts for portions <br /> of the Work, as described on the Bid Proposal attached hereto.
