EUGENE WATER & ELECTRIC BOARD <br /> ELECTRIC UNCERGR(UUND EXTENSION AGREEMENT <br /> ~u~ <br /> Date of Application: August 26, 2004 <br /> CITY OF EUGENE, hereinafter called the customer, requests the Eugene Water 8 Electric Board, hereinafter called EWEB, to extend its electric system to <br /> serve: <br /> Project Name & Location: AWBREY PARK SECONDARY POLE DIP INSTALLATION . <br /> 4291 RNER RD. <br /> Customer agrees the electric distribution extension will be provided in accordance with the requirements and obligations of this Agreement and <br /> <br /> the attached Exhibits. Utility service is also subject to EWEB's applicable policies, regulations and rates now in existence or hereafter adopted, and the <br /> attached drawing #C-23233. Customer has received and read copies of EWEB's existing written policies and standards. <br /> Customer will execute all easements required by EWER at no cost to EWEB. When practical, the customerwill include such easements in the <br /> recorded plat of the above-mentioned development. Customer will further record deed restrictions requiring underground service to all properties to be <br /> served by the underground distribution system being installed. Customer agrees that all easements shall provide that no buildings or structures maybe <br /> constructed on such easements. <br /> Customer is aware of the right, as provided in ORS 92.097, to employ a licensed engineer to design or supervise the installation of the <br /> improvements provided for in this Agreement, but declines to do so. <br /> Unless otherwise specified in this Agreement, the customer agrees to pay for the following extension charges prior to EWEB's commencement of <br /> work: <br /> Contribution in aid of construction = ;1908.00 <br /> Other = WA <br /> All charges above are subject to change ff this Agreement is not signed and returned within thirty (30) days of the application date above and if <br /> the extension faalities are not installed with permanent service connections within six (6) months of the date of application. <br /> This Agreement authorizes EWEB to proceed with the necessary steps to provide electrical underground services as shown on the attached <br /> drawing; however, it is understood that until the conditions of this Agreement are complied with, EWEB will not install the extension factlities. <br /> Customer agrees to inform all subsequent owners of the requirements and obligations of underground service in accordance with the Board's <br /> policies and procedures. This Agreement shall bind and benefit the heirs, personal representatives, successors or assigns of the respective parties. <br /> ® EWEB-CONSTRUCTED SUBSTRUCTURES: <br /> Customer will be responsible for providing, within six Inches (5") of foal grade, compacted level ground ofadequate width for <br /> EWEB to install the utility systems. Customer will provide finished grade stakes and property comers so EWEB can install the utility <br /> system at proper depth and location. Customer will monitor EWEB's installation to assure the installation is according to stakes that <br /> have been provided. <br /> ? CUSTOMER-INSTALLED SUBSTRUCTURES: <br /> Customer will own and maintain all customer-installed ducts and vaults, including service ducts in accordance with EWEB's <br /> service policies. EWER will own and maintain all other underground system facilities. ft is understood that the customer will <br /> construct and furnish service lateral, including duct, trench and backfill in accordance with EWEB policy. <br /> Customer assumes all liability and agrees to indemnify EWEB for all damages to EWEB facilities caused by the customer or <br /> customer's agents. <br /> After one year, EWEB shall assume ownership and responsibility for maintenance and repair of the service lateral conductors <br /> only. (See Board Policy, Electric Service Section IID(5).) <br /> ? DEVELOPER-INSTALLED SUBSTRUCTURES: <br /> EWEB shall allow Developer to construct substructure facilities required to serve a development. <br /> Electric substructure installed in accord with Construction By Developer (CBD) policy must comply with the CBD Handbook, <br /> approved drawings, standards and material specifications. All work will be Inspected, and installations that do not comply will not be <br /> energized. Once accepted, electric substructure installed by the CBD policy becomes the property of EWER.
