Investment, a general partnership <br /> between Norman N. McDougal and Melvin L. McDougal i. ("MCDOUGAL") <br /> AND: The City of Eugene, Oregon ("City"), a municipal corporati~bn, <br /> acting by and through its Parks & Open Space Division ("PARKS") <br /> CONTRACT NO.2004-05344 <br /> RECITALS <br /> A. Lynn and Wiley own a tract of land of approximately 197 acres of deal property in the <br /> north Santa Clara azea as tenants in common (the "SC Tract"), ~ more particularly <br /> described in Exhibit A. The property is entirely outside of, but adja~ent to, the current <br /> Urban Growth Boundary ("UGB"). <br /> <br /> ~r 1, i <br /> B. PARKS desires, approximately 40 to 1.00 acres of property in the Sant # Clara area for use <br /> as a community park, including a# least 40 acres that can be de eloped for active <br /> recreation facilities, such as ballfields, children's play areas, restroo ,picnic facilities, <br /> basketball and tennis courts, and a future community center. This ommunity park is <br /> identified as a need in the Eugene Park and Recreation Plan, adopted y the Eugene City <br /> Council in 1989, and was included in the 1998 Parks & Open Space bo~id measure. <br /> C. PARKS has reviewed available land in the Santa Clara azea. I~o undeveloped or <br /> underdeveloped property of adequate size for a community park exists within the existing <br /> UGB. <br /> D. In order to provide a community park at current City standards to presidents of Santa <br /> Clara, PARKS desires to annex property into the UGB. The extensio of urban services <br /> such as water, sanitary service, stormwater service and streets wi~l be required for <br /> adequate development of a full sernce community park. <br /> i; <br /> E.
