The following actions/responsibilities have been agreed to by the City and the Developer: <br /> <br /> r The Developer's engineer will prepaze a zone change application for both City and <br /> Developer properties. The zone change applications (AG.to RI) will be submitted <br /> sepazately by each party. Each will be responsible for their application fees. <br /> • The Developer will prepare required DSL and COE applications to fill the wetland azea in <br /> the park, including where the new north/south arterial street will cross the wetland. The <br /> Developer will pay the application and consultant fees. The City will take care of any <br /> required mitigation of pazk wetlands through the West Eugene Wetland Mitigation Bank. <br /> (Estimated to be .6 acres at $30,000.00 per acre = $18,000.00) Approximately .2 acres <br /> lies within the future arterial street area. <br /> • The City and Developer will share in the right-of--way dedication and the construction <br /> cost of the two streets that front the pazk site. <br /> • The open drainage way that traverses the site at the southwest corner near Royal Avenue <br /> will be relocated as shown on the attached drawing by the developer. All costs associated <br /> with the relocation, including any required wetland mitigation or enhancement, and/or the <br /> filling of the old channel will be the developer's responsibility. <br /> Donation offer: <br /> The developer has offered has offered to donate to the City, the area along the east/west <br /> drainage way easement and power line easement for park and open space uses as <br /> determined by the City. This area is approximately 90' wide by 955' long (approximately <br /> 2.0 acres). This area contains a large open drainage ditch and high transmission overhead <br /> power lines. It is approximately 570 north of the future pazk site boundary. This area <br /> could provide a pedestrian access corridor between Candlelight Drive, north of <br /> Stagecoach Road, and Daneland Mobile Home Park. Access from this corridor south to <br /> the park site could be achieved along the new arterial street which will border the park on <br /> its western boundary. This access could be enhanced by a wider than normal setback side <br /> walk along the new arterial street. <br /> <br />
