("Contractor") <br /> CONTRACT NO.: 2005-23 <br /> JOB NO.: 4096 <br /> Contractor's CCB No. 2101 <br /> <br /> _ RECITALS <br /> Contractor was the successful bidder for construction of the improvement described in the Contract. <br /> AGREEMENT <br /> SECTION 1. THE CONTRACT. The contract between the parties ("Contract") includes this "City of <br /> Eugene Public Improvement Contract" ("Base Contract', all of the documents in the Project Manual ,the <br /> Project Plans ("Plans"), all properly executed change orders and amendments to .the foregoing, Contractor's <br /> Proposal, including Contractor's price bids and all certifications and representations included therein <br /> (appended to this Base Contract as Exhibit B), the Perfom~ance Bond and Payment Bond securing <br /> Contractor's obligations hereunder and all insurance certificates and endorsements described herein and <br /> delivered by Contractor in connection with the execution of this Base Contract. <br /> SECTION 2. THE PROJECT. The project ("Project") is generally described as the construction of the <br /> Eugene Airport 2004 Pavement Rehabilitation Alpha from A3-A4, A4, Tower Ramp, South Part of the North <br /> Ramp, and North Terminal Ramp as more particularly described in the Plans and in the Specifications. The <br /> Project is a federal funded public works project that is subject to the Davis Bacon Act. <br /> SECTION 3. DEFIIVITIONS. Certain capitalized terms that are not defined in this Base Contract are <br /> defined in Section 10 of the FAA General Provisions. <br /> SECTION 4. THE WORK. Contractor agrees to furnish all labor, material and equipment for the Project, <br /> and to construct the Project in accordance with terms, conditions, specifications and plans contained in the <br /> Contract.
