Upon completion of Project and at its own expense, ODOT shall maintain the highways <br /> and other facilities that are under ODOT jurisdiction. <br /> 6. ODOT will process an approach road application for a public road connection for Moon <br /> Mountain Drive located at the intersection of Glenwood Blvd./Moon Mountain <br /> Dr.lGlenwood Dr. and the Brackenfern Extension as shown on page 9 of Exhibit A, <br /> Drawing 4 according to the provisions of this agreement when submitted by the City of <br /> Eugene. <br /> CITY OF EUGENE OBLIGATIONS <br /> 1. The City of Eugene shall ensure the provision of the Project improvements, within the <br /> timelines set out in the Mitigation Stages and Development Phases of Exhibit "A", and <br /> according to the specifications set out in Exhibit "A". Except for permits necessary to <br /> proceed with related transportation improvements or other pre-development activity, such <br /> as grading/fill or utility extensions, the City of Eugene shall not issue building permits for <br /> residential or commercial development prior to the completion of each stage of <br /> transportation improvements identified for the specific phase of Project development. <br /> 2. The City of Eugene acknowledges that this Agreement is consistent with its <br /> comprehensive plan, including its Transportation System Plan. <br /> 3. The City of Eugene shall be responsible for obtaining the required permits to perform <br /> work upon ODOT right of way within Eugene City limits. <br /> 4. The City of Eugene shall work with the private landowners to ensure that all requirements <br /> of this Agreement, the Construction Permit for a public road approach, and any other <br /> ODOT permits aze met, including, but not limited to, relocation or adjustment of any <br /> conflicting utility facilities located on ODOT right-of--way; all necessary preliminary <br /> engineering and design work required to produce plans and specifications; all necessary <br /> right-of--way acquisition or easements; and all project manager services for administration <br /> of the construction work. <br /> <br /> S. The City of Eugene agrees that all right-of--way acquisition or easement activities on the <br /> State highway system shall be in accord with the Uniform Relocation Assistance & Real <br /> Property Acquisition Policy Act of 1970, as amended; ORS 281.060 and ORS Chapter <br /> 35; FHWA Federal Aid Policy Guide; ODOT's Right-of--Way Manual; and the Code of <br /> Federal Regulations, Title 23, Part 710, and Title 49, Part 24. If the City of Eugene uses a <br /> consultant to obtain right-of--way on the State highway system, the City of Eugene's <br /> consultant selection must be approved by ODOT's Region 3 Right of Way office prior to <br /> work being performed.
