Regards,
Fred
` 1
From: MILOVICH Scott R [mailto:scoff.r.milovich@ci.eugene.or.us]
Sent: Wednesday, April 26, 2006 3:58 PM
To: Fred Caslavka
Subject: Skinner Butte Climber at Riverplay
Fred,
Thanks for taking the time yesterday to talk with Duane from 2G and I about the Skinner Butte Climber at Riverplay':. I think
at the end of our conversation it was clear that we all misunderstood what was happening. Tom at LSI believed that 2G
(and the City) had all of the proper instructions once he sent a revised 3D picture of the structure while 2G was waiting for a
revised plan view layout similar to the those shipped in the instruction packet with the structure -specifically labeled
Structure Layout Inst (11x17) and Playbooster Order#T75530 (24x36). It does beg the question as to why those s~eets
were included at all if they were not intended to be accurate enough for construction. I don't believe 2G ever tried t use
the 3D picture to assemble the structure and I would not have expected them to. I was also unaware that LSI did nbt intend
to include accurate detailed installation instructions with the structure because it is a custom piece. That knowledg@ will
certainly be helpful as we prepare plans and bid projects in the future.
In this case, I will be required to pay 2G the balance of their claim ($17,529) in accordance with our contract. They met the
conditions of the contract, documented their work as I asked them too, and attempted to assemble the Skinner Butt
Climber per the mfr's instructions provided with the structure as directed in the plans and specifications. I could argue
some of the hours, but the cost of my own time to do that would eat up much of the savings.
As I mentioned in a previous email I think that there may be a way to resolve this between the City and LSI in regards to
another piece of play equipment on the same project. I've attached attached an email between Jon Bawden from Rpss
Recreation (our new LSI rep) and Emily Proudfoot in our office detailing the structure and the associated costs. I don't
know if this solution is complicated by the fact that it's going through a different vendor than Recreation Resource. I would
be amenable to recouping a significant portion of my extra costs on the Skinner Butte Climber through some arrangement
on this piece if that's possible. Let me know what you think about that as soon as you can. We're hoping to order this ~1
piece this week as we have a grand opening scheduled for the new playground on July 8. Expedited construction and
shipping would also be valuable to the City as a number of other items can not be constructed until this piece is in place,
Thanks again and I appreciate your willingness to continue the dialogue on this issue.
Scott
Scott Milovich
Principal Landscape Architect
City of Eugene
Public Works Engineering
(541)682-6086
-----Original Message-----
From: Jon Bawden [mailto:jonb@rossrec.com]
Sent: Tuesday, April 25, 2006 4:50 PM
To: PROUDFOOT Emily A
Subject: kalapuya update
Hi Emily,
See attached sketch for review. 6 week minimum lead time. Obviously installation is fairly easy.

5/2/2006
