The City may at this time also elect to request delivery of and <br /> purchase: (1) any or all plants determined by the City to be alive and in good <br /> health but too small for planting on the target date or (2) plants produced in <br /> excess of the requested number. <br /> 3. 3'~ payment will fulfill payment obligations for plant material grown-out to be <br /> paid at the target date time of the year 2 delivery. The contractor will be <br /> compensated for the actual number of plants from plant grow-out that are <br /> determined by the City to be alive and in good health upon delivery on the <br /> target date. Equipment. Except as set forth in Exhibit B, Contractor shall provide all materials, <br /> equipment, supplies or other items required for performance of the Services. <br /> 5. Contract Administration. Each party designates the following as its <br /> representative for purposes of notice pursuant to paragraph 23, and for purposes of <br /> administering this contract: <br /> Contractor: Sheila M. Klest <br /> Trillium Gardens <br /> PO Box 803 <br /> Pleasant Hill, OR 97455 <br /> City: Jean Jancaitis <br /> Wetlands Ecology Coordinator <br /> City of Eugene -Parks and Open Space Division <br /> 1820 Roosevelt Blvd. <br /> Eugene, OR 97402 <br /> Either party may change its designated representative by giving written notice to <br /> the other as provided in paragraph 23. <br /> 6. Performance of Services. Contractor shall perform the Services with a high <br /> degree of professionalism consistent with industry standards,. and shall at all times <br /> during the term of this contract strictly comply with tfie following requirements: ' <br /> 6.1 Supervision. Contractor shall designate afull-time qualified supervisor of <br /> Contractor's performance of the Services, who shall have full authority to act <br /> for and on behalf of Contractor. The supervisor shall be available during <br /> regular business hours. At all times during the supervisor's absence, a <br /> designated subordinate shall be in charge and available at the location of <br /> performance of the Services. <br /> 6.2 Personnel. Contractor acknowledges the high degree of importance City <br /> places on the behavior, appearance and service performed by Contractor <br /> and its personnel. Contractor's personnel shall at all times be neat, clean <br /> and courteous, and Contractor shall not permit its employees or agents to <br /> <br />
