HLS' proposal also addresses to work with the City in the development of as-built <br /> drawings as well as contingency remedial work as directed and authorized by the City to ensure permit <br /> compliance through the required minimum five years of monitoring. HZ,S"fees herein where specified are <br /> bared on a guaranteed maximum price (GMP) within which HLS will invoice the City <br /> for personnel hours <br /> and <br /> project expenses on an as-earned basis <br /> `As-Built' Field Documentation and Report, January 2004 <br /> ACOE permit compliance requires that an 'As-Built' report be submitted within 90 days of <br /> excavation/grading completion and within 90 days of planting completion. HLS proposes to combine these <br /> reports (2) for submittal to the ACOE assuming that the City provides HLS with their digital (AutoCAD) <br /> post-grading survey. <br /> Permit Compliance Wetland Monitoring and Annual Reports, Jannarv 2004-December 2008 <br /> In reviewing the City's permits received from the ACOE, ODSL, and the ODEQ, the only post-construction <br /> monitoring requirements for permit compliance were specified by the ACOE (pp.2-3, Special Conditions 8 <br /> through 14). In summary, these permit conditions require a minimum of 5 years of on-site monitoring. <br /> Annual Reports are due by December 31~ of each monitoring year. Performance criteria require that a <br /> minimum of 80% survival of all planted vegetation be met in any year, with a minimum total area cover of <br /> 65% by Monitoring Year 3 (2006) and 80% by Monitoring Year 5 (2008). Total area cover of invasive <br /> species (Himalayan blackberry, Scot's br~oorn, wild rye, purple loosestrife, reed canarygrass, etc.) shall not <br /> exceed 20 percent cover at any time. Relative coverage of invasive species will be estimated with <br /> recommendations for remedial action(s) in the annual monitoring reports. <br /> NOTE: There is an apparent discrepancy in that Special Condition D talks about monitoring of enhancement and <br /> restoration areas. HLS understands from the City that no 'restoration' is speck to this project and assumes that this <br /> statement regarding restoration within the permit is in error. HLS recommends that the City issue a letter of <br /> r~ correction so that this condition is clamed <br /> <br />
