licensed, bonded and insured contractors chosen by Wildish free of any liens or <br /> encumbrances on, or other claims in, to or against, the Property in connection <br /> therewith. <br /> All alterations and/or improvements shall be at the sole cost and expense of Wildish. <br /> <br /> 11. Entry. Upon at least twenty-four (24) hours notice, Agency shall have the right to <br /> inspect the Property during the term of this Agreement. Such inspection shall be <br /> conducted in a manner so as not to interfere with the daily operations and activities of <br /> Wildish and its agents, employees, contractors and invitees. The notice requirement <br /> shall not interfere with Agency's right to enter the Property at any time in the event of <br /> an emergency. <br /> 12. Indemnification. Wildish shall indemnify and hold Agency harmless against and <br /> from liability and claims of any kind for loss or damage to property of Wildish or any <br /> other person, or for any injury or death of any person arising out of (1) Wildish's <br /> access, use and occupancy of the Property, or any work activity or other things <br /> allowed or suffered by Wildish to be done in, on, or about the Property; (2) any <br /> breach or default by Wildish of any of Wildish's obligations under this Lease <br /> including compliance with zoning and use requirements; (3) any negligent or <br /> otherwise tortuous act or omissions of Wildish, its agents, employees, invitees or <br /> contractors; or (4) the use of disposal of hazardous materials on the Property. <br /> Wildish shall, at its own expense, and by counsel satisfactory to Agency, defend <br /> Agency in any action or proceeding arising from such claim and shall indemnify <br /> Agency for any losses or damages. Such indemnification shall include, but not be <br /> limited to, the cost of defense of any legal claim, action, appeal or review arising out <br /> of any such claim made by any third party. The foregoing indemnity shall survive the <br /> expiration or earlier termination of the Lease. <br /> The Agency shall indemnify and hold Wildish harmless against and from liability and <br /> claims arising from any existing environmental conditions. <br /> 13. Insurance. Wildish shall obtain and maintain continuously in effect at all times <br /> during the term of this Lease, at its own expense, the following insurance on the <br /> Property: <br /> 13.1. Commercial General Liability Insurance. A commercial general <br /> liability insurance policy, including bodily injury and property damage, with <br /> combined single limit coverage of not less than $1 million and an aggregate limit <br /> of $2 million. The policy shall maintain cross liability endorsements and shall <br /> insure performance by Wildish of the indemnity provisions of this Agreement. <br /> The limits of said insurance shall not, however, limit the liability of Wildish <br /> hereunder. Said insurance shall have a Landlord's Protective Liability <br /> endorsement attached thereto. <br /> 13.2. Property Insurance.
