On March 31, 2006, City issued an invitation to bid (the "ITB") for construction of <br /> certain improvements at the Eugene Airport. <br /> B. Contractor submitted a bid, which included a price and all certifications and <br /> representations required under the ITB (the "Bid"), in response to City's ITB. <br /> C. On May 16, 2006, City determined that Contractor was the successful bidder for <br /> construction of the improvcments described in the ITB and this Contract. <br /> AGREEMENT <br /> SECTION 1. THE CONTRACT. The contract between the parties ("Contract") <br /> includes this "City of Eugene Federally Funded Public Improvement Contract" <br /> ("Base Contract"), all of the documents in the Project Manual ,the Project Plans and <br /> Specifications ("Plans"), all properly executed change orders and amendments to the <br /> foregoing, the ITB and the Bid, both attached hereto as Exhibit B, incorporated by <br /> reference, the Performance Bond and Payment Bond securing Contractor's <br /> obligations hereunder, all insurance certificates and endorsements described herein <br /> and delivered by Contractor in connection with the execution of this Base Contract <br /> and all Exhibits to this Base Contract. <br /> 1.1 Exhibits.
