Per our <br /> discussioh, the delineation study area has been revised and is limited to the project <br /> area within the tax lots listed above, which are located south of Airport Road. <br /> The wetlaind boundaries indicated on the attached revised Sheets 1-5 and Sheet 9 are <br /> <br /> ' estimated, boundaries of the assessed outermost extent of wetlands within the study <br /> area. Due to conditions at the time of the original field work (too late for seasonal <br /> hydrology in July and September 2004 and drier than normal February 2005) and the <br /> <br /> ! wetter than normal conditions during my site visit on January 12, 2006, the estimated <br /> boundaries are based on aerial signatures, topographical survey maps, photographs, <br /> precipitation data, and on-site observations. These wetland boundaries can be verified <br /> and revised prior to ground alteration and while spring hydrology can be verified. <br /> <br /> ' Based on the estimated boundaries, the wetland units within the study area total 4.40 <br /> acres. The wetlands, drainages, and Ditch B are subject to the permit requirements of <br /> <br /> ' the state Removal-Fill Law. The roadside ditches A, C, and D are exempt from state <br /> regulation. A state permit is required for fill or excavation of 50 cubic yards or more in a <br /> wetland area or below the ordinary high water line of a waterway (the 2 year recurrence <br /> interval flood elevation, if OHWL cannot be determined). <br /> This concurrence is for purposes of the state Removal-Fill Law only. Federal or local <br /> permit requirements may apply as well. This concurrence is based on information <br /> provided to the agency. The jurisdictional determination is valid for five years from the <br /> date of this letter, unless new information necessitates a revision. Circumstances under <br /> which the Department may change a determination and procedures for renewal of an <br /> expired determination are found in OAR 141-090-0045 (available on our web site or <br /> upon request).
