PERSONAL SERVICES CONTRACT <br /> Artwork <br /> BETWEEN: The City of Eugene, an Oregon <br /> Municipal Corporation (City) <br /> AND: Robinson Earth Scaping, (Contractor) <br /> an individual/sole proprietor <br /> CONTRACT NO.: 2008-00209 <br /> RECITALS <br /> A. Contractor is engaged in the business of Concrete faux rock art. <br /> B. City desires to engage Contractor to provide the Services described in this agreement and <br /> Contractor is willing to provide such Services on the terms and conditions set forth herein. <br /> C. The following are attached and incorporated as a part of this contract: <br /> Exhibit A -City of Eugene Standard Contract Provisions <br /> Exhibit B -Scope of Services and Schedule of Rates <br /> Exhibit C -Concept Plan <br /> AGREEMENT <br /> 1. Services to be provided. Contractor agrees to provide~to City the following services ("the <br /> Work"): <br /> Construct Sand Play Features per attached illustrations and input from designer in the field, <br /> at Willakenzie Park in coordination with contractors constructing other improvements on site. <br /> 2. Time for Completion. Contractor shall coordinate start of work with City and other <br /> contractor working on site and shall complete the Work prior to September 30, 2007. <br /> 3. Compensation. Subject to City's right of offset for breach, Contractor will bill City for the <br /> Services, not-to-exceed $6,500.00 by submitting periodic invoices that conform to the <br /> requirements of Exhibit B. City will make payments within thirty (30) days of receipt of a <br /> properly submitted invoice. Notwithstanding the foregoing, City will have the right to <br /> withhold payment for any item which City disputes in good faith, provided that City pays for <br /> all non-disputed items and takes commercially reasonable action to resolve the dispute. <br /> <br /> r . <br /> CONTRACT NUMBER 2008-00209 <br /> <br />
