As a City engineered and constructed project (eligible fo~ sssessmeot financing). <br />City agress: <br />a) to perform engineeri~g de,sign, c~st estimate, awarcJ of contract, construction inspection, and assessment <br />tabuiation for the improvements; <br />bj to partiapate +n the cost of necessary additional capaaty of improvements beyond the assessable amounts <br />as stipulated in the Eugene Muniapal Code. <br />Owner agrees: <br />a) to pay all engineering and construction costs which are not eligible for assessment financing. <br />b) if the undersigned owner chooses to discontinue U~e City engineering and construcdon pracess prior to <br />execution of a construction coMract, the owner further agrees to pay all engineering and other project-related <br />costs incurred by the City to that point, and to comply with paragraph 2 below, ff applicable. <br />b) to pay actuat Ciry costs incurr~d tor plan review and processing, inspecti4n, materials testing, and other <br />engineering senrices, all of which will be billed and payable monthly with final payment due prior to City's <br />final axeptance of the completed improvements. <br />c) to provide the City a bond, which indudes a one-year warranry period, in an amount sufficierrt to cover aii engineerfng and <br />construofiion costs associated with compledon of the required public improvemerfts. <br />d) to pay oiher charges and levies for pubiic improvemenis, if required. Other charges may include, but are not limited to: <br />1) penatty charges: in the event the property owner fails to make payment when due under this agreement, the properly <br />owner shall be charged a penalty in the amourrt of $25 0~ ten percent (10°k) of the past due amount, whichever is <br />greater. Payment of the penaliy shall not consitute a waiver by the City of its other remedies. <br />2) iMerest charges: properiy owner shall pay interest on all past due amounts at the rate of eighteen percent (189'a) <br />per annum from #ie due date until paid.
