TRADE SERVICES CONTRACT (Non-Facility) :TVUEEN: The City of Eugene, an Oregon Municipal Corporation AND: ~ H& J Construction, Inc. CONTRACT NO.: 2008-00403 EFFECTIVE DATE: January 21, 2008 (City) (Contractor) RECITALS A. Contractor is engaged in the business of wastewater cor~struction, and has obtained and currently holds all licenses, permits, certifications, bonds or other authorization required by Federal, State or local law or regulations to engage in such business. B. City desires to engage Contractor to perform the services described in the attached Exhibit G(the "Services"). Contractor has represented that it is qualified to perform the Services, and desires to enter into this contract with City on the terms set forth below. AGREEMENT 1. Engagement. City hereby engages Contractor to perform the Services, and Contractor agrees to perform the Services, according to the terms and conditions set forth herein and in the following exhibits: Exhibit A- City of Eugene Standard Contract Provisions Exhibit B- Scope of Services Exhibit C- Quote from Contractor 2. Term. The Services of this contract shall be completed by February 8, 2008 unless earlier terminated in accordance with paragraph 16. 3. Consideration. As consideration for performance of the Services, City shall pay Contractor $18,865, as bid by Contractor and described in Exhibit C,'plus or minus modifications requested by City and provided by Contractor at the hourly rate bid. Payment shall be made not later than 30 days after the last day of the month in which the Services were perFormed. , 4. Equipment. Contractor shall provide all materials, equipment, supplies or other items required for performance of the Services. 5. Contract Administration. Each party designates the following as its representative for purposes of notice pursuant to paragraph 23, and for purposes of administering this contract: Non-Facility Trade Service Contract--Page 1 (Revised December 1997)
