Aa a privately er?gineered and constructed prajert with private financing arranged by the Owner. <br /> Owner agrees: <br /> a) to install all required public improvements at no cost to the City; <br /> b) to pay actual City casts inarred for plan review and processing, inspection, materials testing, and other <br /> engineering services, aA of which will be billed arxi payable monthly with final payment due prior to City's <br /> final acceptance of the completed improvemerris. <br /> c) to provide the City a bond, which Indudes a one-year warranty period, in an amount suffictient to cover all engineering and <br /> j construction costs assodated with completion of the required public improvements. <br /> d) to pay other d'rarges and levies for public improvemenis, H required. Other charges may inducts, but are not limited to: <br /> penalty charges: in the event the properly owner fails to make payment when due under this agreement, the propeRy <br /> owner shall be charged a penally in the anxxrnt of.S25 or ten percent (1096) of the past due amount, whichever is <br /> greater. Payment of the penalty shall not cxmsitute a waiver by the City of its other remedies. <br /> 2) interest charges: Properly owner shall pay interest on all past due amounts at the rate of eighteen percent (18°'0) <br /> per annum from the due date until paid.
