<br /> (a) to performengineering design, costestitnate, award of contract, construction Inspection, and assessment tabulation for tfie Improvements;
<br /> (b} to partkipate in the cost of necessary additional capacity of improvements beyond the assessable amounts as stipulated to the Eugene
<br /> Munlcpal Code. -
<br /> Owneragrees:
<br /> (a} to pay all eng ineertng and construction costs which a re not eligible for assessment financing.
<br /> (b) Jf the u ndersigned owner chooses to discontinue the City engineering and construction process prior to execution of a construction
<br /> contract, the owner further agrees to pay al I engineering and project-related costs incurred by the City to that point, and to comply wRh
<br /> paragraph 2 below, If applicable.
<br /> 0 2. As a privately engineerod and wnstruded project with private financing arranged bythe Owner.
<br /> Owner agrees:
<br /> (ai to install ail required public improvements at no cost to the City;
<br /> i (b) to pay atonal City costs Irxu rred for plan review and processing, inspedlon, materials testing, and other engirtieeri ng services, all of which
<br /> will be billed and payable monthly with final payment due priorto City's final acceptance of the completed improvements.
<br /> ~I (d to provid ethe City a bond, which includes cone-year warranty period, in an amount sufficient to cover ail engineering and construction
<br /> costs assodated with completion of the required public improvements.
<br /> (d} to pay other charges and levies for public I mprovements, if requ trod. CKher charges may include, but are not limited to:
<br /> i~ 1) penalty charges: to the event the property owner fails to make payment when due under th Is agreem ent, the property owner shall be
<br /> charged a penahy in the amount of S25 or ten percent (i0%) of the past due amount, whichever is greater. Payment of the penalty shall
<br /> not constitute a waiver by the City of its other remedies.
<br /> 2} Interest charges: property owner shall pay interest on all past due amou nts at the rate of eighteen percent (1896} per ann um from the
<br /> due date until paid.This sum shall be to addition to penalty charges.
