City/ODOT <br />Agreement No. 24651 <br />Section A Title VI, attached hereto be reference and by this reference made a part <br />hereof. In order to meet the requirements of the Title VI of the Civil Rights Act of <br />1964, City shall develop one of the following items. <br />a) A Title VI Program Plan or <br />b) A Nondiscrimination Agreement <br />3. Complaint Procedures: City shall comply with Title VI by deferring all Civil Rights <br />discrimination complaints to the State DOT Civil Rights Office and City must include <br />the following language in any of its contracts under the certification program: <br />Any person who believes that he/she has been excluded from participation in, <br />denied benefits or services of any program or activity administered by the <br />Department or its sub-recipients, consultants, and contractors on the basis of age, <br />disability, gender, race, color, national origin, age income status and religion may <br />bring forth a complaint of discrimination under Title VI and related statutes to the <br />Oregon Department of Transportation, Office of Civil Rights, 800 Airport Road SE, <br />Salem, Oregon, 97301, (503)986-4350. <br />Construction -Bid, Award & Contract Administration <br />Civil Rights <br />Disadvantaged Business Enterprise (DBE), Equal Employment Opportunity <br />Program (EEO), and On-the-Job Training (OJT) <br />1. City, its contractors and subcontractors shall comply with the "United States <br />Department of Transportation (USDOT) Approved Disadvantaged Business <br />Enterprise (DBE) Commitment Requirements" and the "USDOT Approved <br />Disadvantaged Business Enterprise (DBE) Supplemental Required Contract <br />Provisions," incorporated hereto by reference and by this reference made a part <br />hereof. City shall send electronic copies of all completed Committed DBE Breakdown <br />and Certification forms described in the "USDOT Approved DBE Commitment <br />Requirements" to State's Small Business and DBE Program Manager, with a copy to <br />State's Regional Local Agency Liaison, for review and approval. City shall not award <br />any contract(s) prior to receiving approval of said forms from the State's Small <br />Business and DBE Program Manager. City. agrees to ensure that the above <br />provisions (including references therein) shall be incorporated into all contracts .and <br />subcontracts (regardless of tier) describing the work to be performed by DBEs on <br />projects financed in whole or in part with federal funds. Failure by City to carry out <br />these requirements on any project is a material breach of contract, which may result <br />in the termination of the contract or such other remedy as State deems appropriate. <br />Federal regulations Title 49 CFR Part 26, as approved by USDOT, are also <br />incorporated by reference and shall be made a part of any contract specifications and <br />this Agreement. <br />11 <br />
