The Amended Plat for this <br /> vnwitieugene.or.us/pasts <br /> subdivision shows a public drainage and utility easement along the <br /> westerly edge of the property. <br /> The Parks and Open Space Division of Public Works for the City of <br /> Eugene manage the City's open waterway systems. Recently my office <br /> was approached by Don Walker who' owns the vacant property <br /> immediately to the west of Lot 3 . Don is looking to develop this <br /> property and has inquired regarding relocating the existing drainage <br /> channel into the easement as has been done both to the north and <br /> south of Lot 3. His expressed concern was regarding his ability to <br /> use the easement for drainage due to its having been paved over and <br /> Parks and Open fenced. <br /> Space Planning <br /> This letter is being written to you as a courtesy to inform you of <br /> Parks Maintenance provisions of the Oceanway Industrial Park Amended Plat and Eugene <br /> City Code of' which you may be unaware. <br /> Urban Forestry Both the subdivision Amended Plat and City Code 9.6500 require that <br /> Natural Resources the drainage and public utility easement be kept free of <br /> obstructions. The amended plat, under the heading "Restriction", <br /> states: "No building, structure, trees, shrubs or other obstructions <br /> shall be placed or located in or on the public utility easement. " <br /> The fence is clearly such an obstruction. So is the paving, to the <br /> extent that you do not want the paving disturbed. <br /> Don was unclear to me regarding the schedule at which he wishes to <br /> proceed with his project.
