Quinney: Bottom line is that SDCs may not be waived as a term of negotiation; <br /> they must be paid in full at such time permits for development are issued. That said, SDC credits do come into play in this <br /> instance: <br /> SDC Credits <br /> • As we discussed, there will be demolition credit available (local/regional wastewater, stormwater, transportation, <br /> parks)from the demolition of owner's existing improvements, however due to the likely increase in dwelling units <br /> of his proposed development there will also likely be a total net SDC due. <br /> • There may be additional park SDC credit available: <br /> o Public Improvement Credit 1: If property appraisals confirm that there is a net difference in value in the <br /> owner's favor, then his property transfer could be considered as a land dedication that is eligible for park <br /> SDC credit (equal to value of net difference) available for allocation to the park SDC due for the owner's <br /> new adjacent development (after demolition credit is applied). Note that this would be considered a land <br /> dedication that otherwise would be an acquisition paid by the City's park SDC fund. <br /> o Public Improvement Credit 2: If, as a condition of the property transfer, the City requires that the owner <br /> construct the new park's irrigation system as a privately engineered public improvement, then a park SDC <br /> credit(not to exceed the cost that otherwise would have been borne by the City for the irrigation <br /> installation)would be available for allocation to the park SDC due for the owner's new adjacent <br /> development (after demolition credit is applied). <br /> o As you can see, it depends upon how costs pencil out as to whether either public improvement credit <br /> option is viable. Currently the park SDC rate is $1,344.65 per Dwelling Unit. The same rate is used <br /> whether calculating demo credits or a new park SDC due.
