ADMINISTRATIVE ORDER NO. 58-95-08 <br /> of the <br /> Executive Director of the Public Works Department <br /> ORDERING THE CLOSURE OF WEST UNIVERSITY PARK <br /> The Executive Director of the Public Works Department of the City of Eugene finds <br /> that: <br /> A. Section 1.003 of the Park Rules, as amended by Administrative Order No. 58-95-07 <br /> on November 9, 1995 authorizes the temporary closure of parks and/or facilities when the public <br /> need to preserve the welfare and safety of residents in the vicinity of the park(s) outweighs the <br /> public's right of access to parks and/or facilities. <br /> B. The West University Park on 14th Avenue between Hilyard and Patterson Streets <br /> has become a haven for illegal activities creating an atmosphere that is unfit and unsafe for use <br /> by residents of the area. <br /> C. The West University Neighbors Neighborhood Association, University West Small <br /> Business Association, and John Tantaglione of the West University Neighbors have requested that <br /> the park be closed while the City and residents of the area explore options for the future use of <br /> the park to serve the residents and employees of the area. <br /> Now, therefore, based on the above findings, which are hereby adopted, <br /> IT IS HEREBY ORDERED THAT: <br /> 1. The West University Park on 14th Avenue between Hilyard and Patterson Streets <br /> is hereby closed to entry by all persons other than police officers and authorized City employees, <br /> effective 12:01a.m., November 27, 1995. The closure shall remain in effect until reopened by <br /> Administrative Order of the Executive Director of the Public Works Department. <br /> 2. Clearly visible signs shall be posted at park entry points, and such other locations <br /> deemed appropriate advising the public that pursuant to this Administrative Order No. 58-94-08, <br /> entry is prohibited, and that any person entering or remaining within the park after the date of <br /> closure will be subject to the imposition of a fine not to exceed $500 or confinement in jail not <br /> to exceed 30 days or both such fine and imprisonment. <br /> Dated this 20th day of November, 1995. <br /> t t ( t/-( <br /> Executive Director <br /> Eugene Public Works Department <br /> Administrative Order <br />
